                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            April 5, 2011      TO: Honorable Larry Phillips, Chair, House Committee on Transportation      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:HB1736 by Bohac (Relating to the penalty for illegally passing stationary authorized emergency vehicles.), As Introduced    No fiscal implication to the State is anticipated.  The bill would amend the Transportation Code to create a third degree felony for a violation under Section 545.157(b) relating to illegally passing a stationary emergency vehicle if the violation results in serious bodily injury or death. In fiscal year 2010, less than five people were arrested and placed on misdemeanor community supervision for illegally passing stationary authorized emergency vehicles. For this analysis, it is assumed the number of offenders convicted under this statute would not result in a significant impact to the State.
