66 AN ACT
77 relating to the penalty for illegally passing stationary authorized
88 emergency vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.157(b), Transportation Code, is
1111 amended to read as follows:
1212 (b) A violation of this section is:
1313 (1) a misdemeanor punishable under Section 542.401;
1414 (2) a misdemeanor punishable by a fine of $500 if the
1515 violation results in property damage; [or]
1616 (3) a Class B misdemeanor if the violation results in
1717 bodily injury; or
1818 (4) a felony of the third degree if the violation
1919 results in serious bodily injury or death.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect when the offense was committed, and
2424 the former law is continued in effect for that purpose. For purposes
2525 of this section, an offense was committed before the effective date
2626 of this Act if any element of the offense was committed before that
2727 date.
2828 SECTION 3. This Act takes effect September 1, 2011.
