9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 545.157(b), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) A violation of this section is: | |
13 | 13 | (1) a misdemeanor punishable under Section 542.401; | |
14 | 14 | (2) a misdemeanor punishable by a fine of $500 if the | |
15 | 15 | violation results in property damage; [or] | |
16 | 16 | (3) a Class B misdemeanor if the violation results in | |
17 | 17 | bodily injury; or | |
18 | 18 | (4) a felony of the third degree if the violation | |
19 | 19 | results in serious bodily injury or death. | |
20 | 20 | SECTION 2. The change in law made by this Act applies only | |
21 | 21 | to an offense committed on or after the effective date of this Act. | |
22 | 22 | An offense committed before the effective date of this Act is | |
23 | 23 | governed by the law in effect when the offense was committed, and | |
24 | 24 | the former law is continued in effect for that purpose. For purposes | |
25 | 25 | of this section, an offense was committed before the effective date | |
26 | 26 | of this Act if any element of the offense was committed before that | |
27 | 27 | date. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2011. |
