| 9 | 9 | | relating to the transfer of the assets of and the dissolution of the |

| 10 | 10 | | Fort Bend County Water Control and Improvement District No. 1. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. DEFINITIONS. In this Act: |
|---|
| 13 | 13 | | (1) "City" means the City of Sugar Land. |
|---|
| 14 | 14 | | (2) "District" means the Fort Bend County Water |
|---|
| 15 | 15 | | Control and Improvement District No. 1. |
|---|
| 16 | 16 | | SECTION 2. TRANSFER OF ASSETS AND DISSOLUTION OF DISTRICT. |
|---|
| 17 | 17 | | (a) On the date the city council of the city passes a resolution |
|---|
| 18 | 18 | | accepting the assets, debts, and contractual rights and obligations |
|---|
| 19 | 19 | | of the district: |
|---|
| 20 | 20 | | (1) all assets, debts, and contractual rights and |
|---|
| 21 | 21 | | obligations of the district are property of the city; and |
|---|
| 22 | 22 | | (2) the district is dissolved. |
|---|
| 23 | 23 | | (b) On the date of the dissolution of the district, and |
|---|
| 24 | 24 | | notwithstanding Section 51.790, Water Code, ownership of |
|---|
| 25 | 25 | | Certificate of Adjudication No. 11-5170, including any attachments |
|---|
| 26 | 26 | | or amendments to the certificate, transfers to the city. |
|---|
| 27 | 27 | | (c) The city shall notify the Texas Commission on |
|---|
| 28 | 28 | | Environmental Quality of the dissolution of the district and the |
|---|
| 29 | 29 | | transfer of Certificate of Adjudication No. 11-5170 to the city. |
|---|
| 30 | 30 | | (d) On receipt of notice under Subsection (c) of this |
|---|
| 31 | 31 | | section, the Texas Commission on Environmental Quality shall note |
|---|
| 32 | 32 | | in its records that Certificate of Adjudication No. 11-5170 is |
|---|
| 33 | 33 | | owned by the city. The Texas Commission on Environmental Quality |
|---|
| 34 | 34 | | shall, as a ministerial act, transfer the certificate to the city |
|---|
| 35 | 35 | | without further application, notice, or hearing. A person, party, |
|---|
| 36 | 36 | | or entity does not have any right of protest, objection, or |
|---|
| 37 | 37 | | administrative review of the transfer prescribed by this Act. |
|---|
| 38 | 38 | | (e) The transfer of Certificate of Adjudication No. 11-5170 |
|---|
| 39 | 39 | | to the city does not affect or impair the priority, extent, |
|---|
| 40 | 40 | | validity, or purpose of the certificate. |
|---|
| 41 | 41 | | SECTION 3. EXPIRATION OF ACT. This Act expires September 1, |
|---|
| 42 | 42 | | 2013. |
|---|
| 43 | 43 | | SECTION 4. EFFECTIVE DATE. This Act takes effect |
|---|
| 44 | 44 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 45 | 45 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 46 | 46 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 47 | 47 | | immediate effect, this Act takes effect September 1, 2011. |
