88 AN ACT
99 relating to the transfer of the assets of and the dissolution of the
1010 Fort Bend County Water Control and Improvement District No. 1.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "City" means the City of Sugar Land.
1414 (2) "District" means the Fort Bend County Water
1515 Control and Improvement District No. 1.
1616 SECTION 2. TRANSFER OF ASSETS AND DISSOLUTION OF DISTRICT.
1717 (a) On the date the city council of the city passes a resolution
1818 accepting the assets, debts, and contractual rights and obligations
1919 of the district:
2020 (1) all assets, debts, and contractual rights and
2121 obligations of the district are property of the city; and
2222 (2) the district is dissolved.
2323 (b) On the date of the dissolution of the district, and
2424 notwithstanding Section 51.790, Water Code, ownership of
2525 Certificate of Adjudication No. 11-5170, including any attachments
2626 or amendments to the certificate, transfers to the city.
2727 (c) The city shall notify the Texas Commission on
2828 Environmental Quality of the dissolution of the district and the
2929 transfer of Certificate of Adjudication No. 11-5170 to the city.
3030 (d) On receipt of notice under Subsection (c) of this
3131 section, the Texas Commission on Environmental Quality shall note
3232 in its records that Certificate of Adjudication No. 11-5170 is
3333 owned by the city. The Texas Commission on Environmental Quality
3434 shall, as a ministerial act, transfer the certificate to the city
3535 without further application, notice, or hearing. A person, party,
3636 or entity does not have any right of protest, objection, or
3737 administrative review of the transfer prescribed by this Act.
3838 (e) The transfer of Certificate of Adjudication No. 11-5170
3939 to the city does not affect or impair the priority, extent,
4040 validity, or purpose of the certificate.
4141 SECTION 3. EXPIRATION OF ACT. This Act expires September 1,
4242 2013.
4343 SECTION 4. EFFECTIVE DATE. This Act takes effect
4444 immediately if it receives a vote of two-thirds of all the members
4545 elected to each house, as provided by Section 39, Article III, Texas
4646 Constitution. If this Act does not receive the vote necessary for
4747 immediate effect, this Act takes effect September 1, 2011.
