 A BILL TO BE ENTITLED
 AN ACT
 relating to a report on efforts made by the Department of Family and
 Protective Services to place children in adoptive homes.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  The heading to Subchapter D, Chapter 162, Family
 Code, is amended to read as follows:
 SUBCHAPTER D. ADOPTION SERVICES BY THE DEPARTMENT OF FAMILY AND
 PROTECTIVE [AND REGULATORY] SERVICES
 SECTION 2.  Section 162.301(3), Family Code, is amended to
 read as follows:
 (3)  "Department" means the Department of Family and
 Protective [and Regulatory] Services.
 SECTION 3.  Subchapter D, Chapter 162, Family Code, is
 amended by adding Section 162.310 to read as follows:
 Sec. 162.310.  REPORT TO GOVERNOR AND LEGISLATURE. (a)  The
 department shall, not later than January 1 of each year, submit to
 the governor, lieutenant governor, speaker of the house of
 representatives, and appropriate committees of the legislature a
 report describing the efforts made by the department to place
 children in the department's managing conservatorship in adoptive
 homes.
 (b)  The report must include the following information for
 the preceding year, sorted by department region and district:
 (1)  the number of children in the department's
 managing conservatorship;
 (2)  the number and percentage of children placed by
 the department in an adoptive home;
 (3)  the number and percentage of children who were
 separated from a sibling when placed by the department in an
 adoptive home; and
 (4)  the number of children placed by the department in
 an adoptive home who were in the department's managing
 conservatorship for:
 (A)  less than one year;
 (B)  at least one year but less than three years;
 and
 (C)  three years or more.
 SECTION 4.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
