99 relating to the practice of cosmetology.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1602.002(a), Occupations Code, is
1212 amended to read as follows:
1313 (a) In this chapter, "cosmetology" means the practice of
1414 performing or offering to perform for compensation any of the
1515 following services:
1616 (1) treating a person's hair by:
1717 (A) providing any method of treatment as a
1818 primary service, including arranging, beautifying, bleaching,
1919 cleansing, coloring, cutting, dressing, dyeing, processing,
2020 shampooing, shaping, singeing, straightening, styling, tinting, or
2121 waving;
2222 (B) providing a necessary service that is
2323 preparatory or ancillary to a service under Paragraph (A),
2424 including bobbing, clipping, cutting, or trimming a person's hair
2525 or shaving a person's neck with a safety razor; or
2626 (C) cutting the person's hair as a separate and
2727 independent service for which a charge is directly or indirectly
2828 made separately from charges for any other service;
2929 (2) weaving or braiding a person's hair;
3030 (3) shampooing and conditioning a person's hair;
3131 (4) servicing a person's wig or artificial hairpiece
3232 on a person's head or on a block after the initial retail sale and
3333 servicing in any manner listed in Subdivision (1);
3434 (5) treating a person's mustache or beard by
3535 arranging, beautifying, coloring, processing, styling, [or]
3636 trimming, or shaving with a safety razor;
3737 (6) cleansing, stimulating, or massaging a person's
3838 scalp, face, neck, or arms:
3939 (A) by hand or by using a device, apparatus, or
4040 appliance; and
4141 (B) with or without the use of any cosmetic
4242 preparation, antiseptic, tonic, lotion, or cream;
4343 (7) beautifying a person's face, neck, or arms using a
4444 cosmetic preparation, antiseptic, tonic, lotion, powder, oil,
4545 clay, cream, or appliance;
4646 (8) administering facial treatments;
4747 (9) removing superfluous hair from a person's body
4848 using depilatories or mechanical tweezers;
4949 (10) treating a person's nails by:
5050 (A) cutting, trimming, polishing, tinting,
5151 coloring, cleansing, or manicuring; or
5252 (B) attaching false nails; or
5353 (11) massaging, cleansing, treating, or beautifying a
5454 person's hands or feet.
5555 SECTION 2. This Act takes effect September 1, 2011.
