| 7 | 7 | | relating to a public school student's eligibility for a public |

| 8 | 8 | | education grant to attend another public school. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 29.202(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) A student is eligible to receive a public education |
|---|
| 13 | 13 | | grant or to attend another public school in the district in which |
|---|
| 14 | 14 | | the student resides under this subchapter if the student is |
|---|
| 15 | 15 | | assigned to attend a public school campus: |
|---|
| 16 | 16 | | (1) at which 50 percent or more of the students did not |
|---|
| 17 | 17 | | perform satisfactorily on an assessment instrument administered |
|---|
| 18 | 18 | | under Section 39.023(a) or (c) in any two of the preceding three |
|---|
| 19 | 19 | | years; or |
|---|
| 20 | 20 | | (2) that[, at any time] in either of the preceding two |
|---|
| 21 | 21 | | years, was assigned a rating of unacceptable performance [three |
|---|
| 22 | 22 | | years, failed to satisfy any standard] under Section 39.054 |
|---|
| 23 | 23 | | [39.054(d)]. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies |
|---|
| 25 | 25 | | beginning with the 2011-2012 school year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2011. |
