66 AN ACT
77 relating to a public school student's eligibility for a public
88 education grant to attend another public school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.202(a), Education Code, is amended to
1111 read as follows:
1212 (a) A student is eligible to receive a public education
1313 grant or to attend another public school in the district in which
1414 the student resides under this subchapter if the student is
1515 assigned to attend a public school campus:
1616 (1) at which 50 percent or more of the students did not
1717 perform satisfactorily on an assessment instrument administered
1818 under Section 39.023(a) or (c) in any two of the preceding three
1919 years; or
2020 (2) that[, at any time] in either of the preceding two
2121 years, was assigned a rating of unacceptable performance [three
2222 years, failed to satisfy any standard] under Section 39.054
2323 [39.054(d)].
2424 SECTION 2. The change in law made by this Act applies
2525 beginning with the 2011-2012 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2011.
