88 AN ACT
99 relating to the management of groundwater production by groundwater
1010 conservation districts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 36.001(25), Water Code, is amended to
1313 read as follows:
1414 (25) "Modeled [Managed] available groundwater" means
1515 the amount of water that the executive administrator determines may
1616 be produced on an average annual basis to achieve a [permitted by a
1717 district for beneficial use in accordance with the] desired future
1818 condition established [of the aquifer as determined] under Section
1919 36.108.
2020 SECTION 2. Section 36.1071(e), Water Code, is amended to
2121 read as follows:
2222 (e) In the management plan described under Subsection (a),
2323 the district shall:
2424 (1) identify the performance standards and management
2525 objectives under which the district will operate to achieve the
2626 management goals identified under Subsection (a);
2727 (2) specify, in as much detail as possible, the
2828 actions, procedures, performance, and avoidance that are or may be
2929 necessary to effect the plan, including specifications and proposed
3030 rules;
3131 (3) include estimates of the following:
3232 (A) modeled [managed] available groundwater in
3333 the district based on the desired future condition established
3434 under Section 36.108;
3535 (B) the amount of groundwater being used within
3636 the district on an annual basis;
3737 (C) the annual amount of recharge from
3838 precipitation, if any, to the groundwater resources within the
3939 district;
4040 (D) for each aquifer, the annual volume of water
4141 that discharges from the aquifer to springs and any surface water
4242 bodies, including lakes, streams, and rivers;
4343 (E) the annual volume of flow into and out of the
4444 district within each aquifer and between aquifers in the district,
4545 if a groundwater availability model is available;
4646 (F) the projected surface water supply in the
4747 district according to the most recently adopted state water plan;
4848 and
4949 (G) the projected total demand for water in the
5050 district according to the most recently adopted state water plan;
5151 and
5252 (4) consider the water supply needs and water
5353 management strategies included in the adopted state water plan.
5454 SECTION 3. Section 36.108(o), Water Code, is amended to
5555 read as follows:
5656 (o) The districts shall submit the conditions established
5757 under this section to the executive administrator. The executive
5858 administrator shall provide each district and regional water
5959 planning group located wholly or partly in the management area with
6060 the modeled [managed] available groundwater in the management area
6161 based upon the desired future condition of the groundwater
6262 resources established under this section.
6363 SECTION 4. Section 36.1132, Water Code, is amended to read
6464 as follows:
6565 Sec. 36.1132. PERMITS BASED ON MODELED [MANAGED] AVAILABLE
6666 GROUNDWATER. (a) A district, to the extent possible, shall issue
6767 permits up to the point that the total volume of exempt and
6868 permitted groundwater production will achieve an applicable
6969 desired future condition under Section 36.108 [permitted equals the
7070 managed available groundwater, if administratively complete permit
7171 applications are submitted to the district].
7272 (b) In issuing permits, the district shall manage total
7373 groundwater production on a long-term basis to achieve an
7474 applicable desired future condition and consider:
7575 (1) the modeled available groundwater determined by
7676 the executive administrator;
7777 (2) the executive administrator's estimate of the
7878 current and projected amount of groundwater produced under
7979 exemptions granted by district rules and Section 36.117;
8080 (3) the amount of groundwater authorized under permits
8181 previously issued by the district;
8282 (4) a reasonable estimate of the amount of groundwater
8383 that is actually produced under permits issued by the district; and
8484 (5) yearly precipitation and production patterns.
8585 (c) In developing the estimate of exempt use under
8686 Subsection (b)(2), the executive administrator shall solicit
8787 information from each applicable district.
8888 SECTION 5. This Act takes effect September 1, 2011.
