| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 441.168, Government Code, is amended to |
|---|
| 14 | 14 | | read as follows: |

| 15 | 15 | | Sec. 441.168. MICROFILMING AND STORING LOCAL GOVERNMENT |
|---|
| 16 | 16 | | RECORDS. (a) On request of a local government, the director and |
|---|
| 17 | 17 | | librarian may provide for the microfilming or storage of the local |
|---|
| 18 | 18 | | government records of that local government. Local government |
|---|
| 19 | 19 | | records are open to the director and librarian for that purpose. |
|---|
| 20 | 20 | | (b) The commission shall establish fees for the |
|---|
| 21 | 21 | | microfilming and storage of local government records in amounts |
|---|
| 22 | 22 | | sufficient to cover the costs of administering and expanding the |
|---|
| 23 | 23 | | microfilming and storage services of the records management |
|---|
| 24 | 24 | | division in the state library for the purpose of implementing |
|---|
| 25 | 25 | | Subsection (a). The fees received under this section shall be |
|---|
| 26 | 26 | | deposited in the state treasury in an account to be used only for |
|---|
| 27 | 27 | | the costs of administering [administrating] and expanding |
|---|
| 28 | 28 | | microfilming and storage services. |
|---|
| 29 | 29 | | (c) The director and librarian may allow the state records |
|---|
| 30 | 30 | | center to provide for the economical and efficient storage, |
|---|
| 31 | 31 | | accessibility, protection, and final disposition of inactive and |
|---|
| 32 | 32 | | vital local government records under this section. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2011. |
