99 AN ACT
1010 relating to storage of local government records by the Texas State
1111 Library and Archives Commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 441.168, Government Code, is amended to
1414 read as follows:
1515 Sec. 441.168. MICROFILMING AND STORING LOCAL GOVERNMENT
1616 RECORDS. (a) On request of a local government, the director and
1717 librarian may provide for the microfilming or storage of the local
1818 government records of that local government. Local government
1919 records are open to the director and librarian for that purpose.
2020 (b) The commission shall establish fees for the
2121 microfilming and storage of local government records in amounts
2222 sufficient to cover the costs of administering and expanding the
2323 microfilming and storage services of the records management
2424 division in the state library for the purpose of implementing
2525 Subsection (a). The fees received under this section shall be
2626 deposited in the state treasury in an account to be used only for
2727 the costs of administering [administrating] and expanding
2828 microfilming and storage services.
2929 (c) The director and librarian may allow the state records
3030 center to provide for the economical and efficient storage,
3131 accessibility, protection, and final disposition of inactive and
3232 vital local government records under this section.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
