99 AN ACT
1010 relating to the continuation and functions of the Commission on
1111 State Emergency Communications.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 771.032, Health and Safety Code, is
1414 amended to read as follows:
1515 Sec. 771.032. APPLICATION OF SUNSET ACT. The Commission on
1616 State Emergency Communications is subject to Chapter 325,
1717 Government Code (Texas Sunset Act). Unless continued in existence
1818 as provided by that chapter, the commission is abolished and this
1919 chapter expires September 1, 2023 [2011].
2020 SECTION 2. Subchapter B, Chapter 771, Health and Safety
2121 Code, is amended by adding Section 771.040 to read as follows:
2222 Sec. 771.040. NEGOTIATED RULEMAKING AND ALTERNATIVE
2323 DISPUTE RESOLUTION. (a) The commission shall develop and
2424 implement a policy to encourage the use of:
2525 (1) negotiated rulemaking procedures under Chapter
2626 2008, Government Code, for the adoption of commission rules; and
2727 (2) appropriate alternative dispute resolution
2828 procedures under Chapter 2009, Government Code, to assist in the
2929 resolution of internal and external disputes under the commission's
3030 jurisdiction.
3131 (b) The commission's procedures relating to alternative
3232 dispute resolution must conform, to the extent possible, to any
3333 model guidelines issued by the State Office of Administrative
3434 Hearings for the use of alternative dispute resolution by state
3535 agencies.
3636 (c) The commission shall:
3737 (1) coordinate the implementation of the policy
3838 adopted under Subsection (a);
3939 (2) provide training as needed to implement the
4040 procedures for negotiated rulemaking or alternative dispute
4141 resolution; and
4242 (3) collect data concerning the effectiveness of those
4343 procedures.
4444 SECTION 3. Subchapter C, Chapter 771, Health and Safety
4545 Code, is amended by adding Section 771.0511 to read as follows:
4646 Sec. 771.0511. EMERGENCY SERVICES INTERNET PROTOCOL
4747 NETWORK; EMERGENCY COMMUNICATIONS ADVISORY COMMITTEE. (a) In this
4848 section:
4949 (1) "Advisory committee" means the Emergency
5050 Communications Advisory Committee.
5151 (2) "State-level emergency services Internet Protocol
5252 network" means a private Internet Protocol network or Virtual
5353 Private Network that:
5454 (A) is used for communications between and among
5555 public safety answering points and other entities that support or
5656 are supported by public safety answering points in providing
5757 emergency call handling and response; and
5858 (B) will be a part of the Texas Next Generation
5959 Emergency Communications System.
6060 (b) The commission, with the assistance of an advisory
6161 committee, may coordinate the development, implementation, and
6262 management of an interconnected, state-level emergency services
6363 Internet Protocol network.
6464 (c) If the commission acts under Subsection (b), the
6565 commission shall establish policy and oversee agency involvement in
6666 the development and implementation of the interconnected,
6767 state-level emergency services Internet Protocol network.
6868 (d) If the commission acts under Subsection (b), the
6969 commission shall appoint an advisory committee. The advisory
7070 committee must include at least:
7171 (1) one representative from a regional planning
7272 commission;
7373 (2) one representative from an emergency
7474 communication district, as that term is defined by Section
7575 771.001(3)(A); and
7676 (3) one representative from an emergency
7777 communication district, as that term is defined by Section
7878 771.001(3)(B).
7979 (e) In appointing members of an advisory committee, the
8080 commission shall consult with regional planning commissions and
8181 emergency communication districts throughout the state. The
8282 commission shall ensure that each member of the advisory committee
8383 has appropriate training, experience, and knowledge in 9-1-1
8484 systems and network management to assist in the implementation and
8585 operation of a complex network.
8686 SECTION 4. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2011.
