 A BILL TO BE ENTITLED
 AN ACT
 relating to utilities' expenditures for recharging stations for
 electric vehicles.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter B, Chapter 36, Utilities Code, is
 amended by adding Section 36.066 to read as follows:
 Sec. 36.066.  ALLOWANCE OF EXPENSES RELATED TO ELECTRIC CAR
 RECHARGING STATIONS. (a) A regulatory authority shall allow as
 reasonable and necessary expenses an electric utility's
 expenditures related to recharging stations for electric vehicles
 to the extent the expenditures qualify for inclusion under
 Subsection (b).
 (b)  To qualify for inclusion as a reasonable and necessary
 expense for ratemaking purposes, an electric utility's expenditure
 must be made:
 (1)  with a business incorporated or formed in this
 state and located in this state; and
 (2)  for equipment, a good, or a service necessary for
 planning, designing, constructing, installing, or maintaining for
 the electric utility a recharging station:
 (A)  for electric vehicles designed for roadway
 use; and
 (B)  the core functional components of which are
 wholly or substantially produced or assembled at a location in this
 state by a business incorporated or formed in this state.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
