77 relating to optional fees for the registration of motor vehicles in
88 certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.006(d), Transportation Code, is
1111 amended to read as follows:
1212 (d) Sections [Section] 502.172 and 502.1721 do [does] not
1313 apply to an all-terrain vehicle or a recreational off-highway
1414 vehicle.
1515 SECTION 2. Section 502.103, Transportation Code, is amended
1616 to read as follows:
1717 Sec. 502.103. DISPOSITION OF OPTIONAL COUNTY AND MUNICIPAL
1818 ROAD AND BRIDGE FEES [FEE]. Each Monday a county
1919 assessor-collector shall apportion the collections for the
2020 preceding week for a fee imposed under Section 502.172 or 502.1721
2121 by:
2222 (1) crediting an amount equal to 97 percent of the
2323 collections to the county road and bridge fund or to the municipal
2424 treasurer, as appropriate; and
2525 (2) sending to the department an amount equal to three
2626 percent of the collections to defray the department's costs of
2727 administering Section 502.172 or 502.1721.
2828 SECTION 3. Section 502.167(j), Transportation Code, is
2929 amended to read as follows:
3030 (j) A person may register a semitrailer under this section
3131 for a registration period of five consecutive years if the person:
3232 (1) applies to the department for the five-year
3333 registration;
3434 (2) provides proof of the person's eligibility to
3535 register the vehicle under this subsection as required by the
3636 department; and
3737 (3) pays a fee of $15, plus any applicable fee under
3838 Section 502.172 or 502.1721, for each year included in the
3939 registration period.
4040 SECTION 4. Subchapter D, Chapter 502, Transportation Code,
4141 is amended by adding Section 502.1721 to read as follows:
4242 Sec. 502.1721. OPTIONAL MUNICIPAL ROAD AND BRIDGE FEE. (a)
4343 This section applies only to a municipality that borders the United
4444 Mexican States and has a population of 500,000 or more.
4545 (b) Notwithstanding Section 502.003, the governing body of a
4646 municipality by order may call an election on the issue of imposing
4747 an additional fee for registering a vehicle at an address in the
4848 municipality. The election must be held on a uniform election date
4949 under Section 41.001, Election Code. If a majority of the votes
5050 cast at the election approve the imposition of the fee, the fee is
5151 imposed. A fee imposed under this section may take effect only on
5252 January 1 of a year. The municipality must notify the county in
5353 which it is located and the department not later than September 1 of
5454 the year preceding the year in which the fee takes effect.
5555 (c) A fee imposed under this section may not exceed the
5656 amount of the fee imposed under Section 502.172 by the county in
5757 which the vehicle is registered.
5858 (d) An order under Subsection (b) calling an election must:
5959 (1) list the amount of the additional fee to be
6060 imposed; and
6161 (2) list and generally describe the projects to be
6262 funded with the additional fee.
6363 (e) The ballot at an election held under this section must
6464 be printed to permit voting for or against the proposition:
6565 "Authorizing ________ (insert name of municipality) to impose an
6666 additional registration fee in the amount of $________ (insert
6767 amount of additional fee) for the purpose of financing ____________
6868 (describe the road or bridge projects to be funded)."
6969 (f) A vehicle that may be registered under this chapter
7070 without payment of a registration fee may be registered without
7171 payment of the additional fee under this section.
7272 (g) The county assessor-collector of a county containing a
7373 municipality imposing a fee under this section shall collect the
7474 additional fee for a vehicle when other fees imposed under this
7575 chapter are collected. The county assessor-collector shall
7676 distribute the fees collected under this section to the municipal
7777 treasurer in the manner provided by Section 502.103.
7878 (h) The municipality may use the fee revenue collected under
7979 this section only for road or bridge projects in the municipality.
8080 (i) The department shall collect the additional fee on a
8181 vehicle that is owned by a resident of a municipality imposing a fee
8282 under this section and that, under this chapter, must be registered
8383 directly with the department. The department shall send all fees
8484 collected for a municipality under this subsection to the municipal
8585 treasurer to be used as provided by Subsection (h).
8686 (j) The department shall adopt rules and develop forms
8787 necessary to administer registration by mail for a vehicle being
8888 registered in a county containing a municipality imposing a fee
8989 under this section.
9090 SECTION 5. Section 502.353(g), Transportation Code, is
9191 amended to read as follows:
9292 (g) A vehicle registered under this section is not subject
9393 to the fee required by Section 502.172, 502.1721, or 502.173.
9494 SECTION 6. This Act takes effect September 1, 2011.
