99 relating to financial assurance required for certain commercial or
1010 municipal solid waste facilities by the Texas Commission on
1111 Environmental Quality.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 361, Health and Safety
1414 Code, is amended by adding Section 361.0851 to read as follows:
1515 Sec. 361.0851. ADDITIONAL FINANCIAL ASSURANCE REQUIREMENTS
1616 FOR CERTAIN COMMERCIAL OR MUNICIPAL SOLID WASTE FACILITIES. (a)
1717 The commission shall adopt rules to require additional financial
1818 assurance for a commercial or municipal solid waste facility,
1919 including a facility for which a permit or registration described
2020 by Section 361.085(k) is issued, if the facility:
2121 (1) treats or processes liquid waste or industrial
2222 nonhazardous liquid waste for disposal off-site or for discharge;
2323 (2) has:
2424 (A) a record of significant noncompliance with
2525 permitted limits; or
2626 (B) no compliance record; and
2727 (3) is not owned by, operated by, or affiliated with a
2828 local government or a person that has a permit to dispose of
2929 municipal solid waste.
3030 (b) For the purposes of Subsection (a), a facility has a
3131 record of significant noncompliance with permitted limits if, in
3232 the preceding five years, the owner or operator of the facility:
3333 (1) has been issued by the commission a final order, a
3434 notice of enforcement, or two or more notices of violation alleging
3535 or finding that the facility:
3636 (A) accepted unauthorized waste;
3737 (B) accepted waste in an amount that exceeds a
3838 permit limit by more than five percent; or
3939 (C) discharged water or waste without
4040 authorization; or
4141 (2) has been subject to a civil or criminal penalty for
4242 actions at the facility described by Subdivision (1).
4343 (c) This section does not apply to:
4444 (1) a composting facility;
4545 (2) a site at which sludge is applied; or
4646 (3) a municipal solid waste management facility exempt
4747 from permit requirements under Section 361.111.
4848 SECTION 2. This Act takes effect September 1, 2011.
