66 AN ACT
77 relating to a defense to prosecution for the offense of cruelty to
88 nonlivestock animals under certain circumstances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.092(d), Penal Code, is amended to
1111 read as follows:
1212 (d) It is a defense to prosecution under this section that:
1313 (1) the actor had a reasonable fear of:
1414 (A) bodily injury to the actor or to another
1515 person by a dangerous wild animal as defined by Section 822.101,
1616 Health and Safety Code; or
1717 (B) serious bodily injury to the actor or to
1818 another person by a dog as defined by Section 822.041, Health and
1919 Safety Code; or
2020 (2) the actor was engaged in bona fide experimentation
2121 for scientific research.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 governed by the law in effect when the offense was committed, and
2626 the former law is continued in effect for that purpose. For purposes
2727 of this section, an offense was committed before the effective date
2828 of this Act if any element of the offense occurred before that date.
2929 SECTION 3. This Act takes effect September 1, 2011.
