9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 42.092(d), Penal Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | (d) It is a defense to prosecution under this section that: | |
13 | 13 | (1) the actor had a reasonable fear of: | |
14 | 14 | (A) bodily injury to the actor or to another | |
15 | 15 | person by a dangerous wild animal as defined by Section 822.101, | |
16 | 16 | Health and Safety Code; or | |
17 | 17 | (B) serious bodily injury to the actor or to | |
18 | 18 | another person by a dog as defined by Section 822.041, Health and | |
19 | 19 | Safety Code; or | |
20 | 20 | (2) the actor was engaged in bona fide experimentation | |
21 | 21 | for scientific research. | |
22 | 22 | SECTION 2. The change in law made by this Act applies only | |
23 | 23 | to an offense committed on or after the effective date of this Act. | |
24 | 24 | An offense committed before the effective date of this Act is | |
25 | 25 | governed by the law in effect when the offense was committed, and | |
26 | 26 | the former law is continued in effect for that purpose. For purposes | |
27 | 27 | of this section, an offense was committed before the effective date | |
28 | 28 | of this Act if any element of the offense occurred before that date. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2011. |
