| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter F, Chapter 370, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 370.2511 to read as follows: |
|---|
| 13 | 13 | | Sec. 370.2511. BOARD OF DIRECTORS: CERTAIN AUTHORITIES. (a) |
|---|
| 14 | 14 | | This section applies only to an authority created by a |
|---|
| 15 | 15 | | municipality. |
|---|
| 16 | 16 | | (b) The governing body of a municipality by order may |
|---|
| 17 | 17 | | establish the governing body as the board of directors of an |
|---|
| 18 | 18 | | authority. |
|---|
| 19 | 19 | | (c) If the board of directors of an authority created by a |
|---|
| 20 | 20 | | municipality consists of the members of the governing body of the |
|---|
| 21 | 21 | | municipality, the presiding officers of the governing body of the |
|---|
| 22 | 22 | | municipality are the presiding officers of the board. |
|---|
| 23 | 23 | | (d) Each director of a board under this section has equal |
|---|
| 24 | 24 | | status and may vote. |
|---|
| 25 | 25 | | (e) The vote of a majority attending a board meeting is |
|---|
| 26 | 26 | | necessary for any action taken by a board under this section. If a |
|---|
| 27 | 27 | | vacancy exists on a board, the majority of directors serving on the |
|---|
| 28 | 28 | | board is a quorum. |
|---|
| 29 | 29 | | (f) The governing body of a municipality that becomes the |
|---|
| 30 | 30 | | board of an existing authority under this section shall by |
|---|
| 31 | 31 | | resolution provide for the transfer process that establishes the |
|---|
| 32 | 32 | | governing body as the board of the authority. |
|---|
| 33 | 33 | | (g) If the board of directors of an authority created by a |
|---|
| 34 | 34 | | municipality consists of the members of the governing body of the |
|---|
| 35 | 35 | | municipality, Sections 370.251, 370.2515, 370.252, 370.2521, |
|---|
| 36 | 36 | | 370.2522, 370.2523, 370.253, 370.254, 370.255 do not apply to the |
|---|
| 37 | 37 | | board. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2011. |
