A BILL TO BE ENTITLED
AN ACT
relating to the location of water utility rate hearings conducted
by the Texas Commission on Environmental Quality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 13.041(c), Water Code, is amended to
read as follows:
(c) The commission may call and hold hearings, administer
oaths, receive evidence at hearings, issue subpoenas to compel the
attendance of witnesses and the production of papers and documents,
and make findings of fact and decisions with respect to
administering this chapter or the rules, orders, or other actions
of the commission. A hearing under this subsection shall be held at
a location within the service area of the utility that is the
subject of the hearing.
SECTION 2. This Act takes effect September 1, 2011.
