7	7	relating to the election of directors of the Real-Edwards
8	8	Conservation and Reclamation District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 11, Chapter 341, Acts of the 56th
11	11	Legislature, Regular Session, 1959, is amended to read as follows:
12	12	Sec. 11. (a) The government and control of the District
13	13	shall be vested in a Board of Directors consisting of nine [(9)]
14	14	members. Directors serve staggered four-year terms expiring on
15	15	January 1 of odd-numbered years.
16	16	(b) The District shall hold an election on the uniform
17	17	election date in November of each even-numbered year to elect the
18	18	appropriate number of Directors. [There shall be held in the
19	19	District on the first Tuesday after the first Monday in November in
20	20	each even-numbered year an election within the District for the
21	21	selection of Directors to succeed those whose terms expire on said
22	22	date. Such election shall be held in such voting boxes as are
23	23	designated by the Board of Directors, and notice of such election
24	24	shall be given by the Secretary of the Board of Directors by posting
25	25	in three (3) public places within the District a copy of the order
26	26	of the Board of Directors directing the time and places of holding
27	27	the election. No person shall be selected a Director unless he be
28	28	above the age of twenty-one (21) years and a resident within the
29	29	territorial limits of the District.]
30	30	(b-1) An applicant to be a candidate for election as a
31	31	Director must indicate on the application either:
32	32	(1) the position number of the District that the
33	33	person seeks to represent; or
34	34	(2) that the person seeks to run at large.
35	35	(b-2) To be eligible to be a candidate for Director position
36	36	number 1, 3, 5, or 7, a person must be a registered voter in Edwards
37	37	County.
38	38	(b-3) To be eligible to be a candidate for Director position
39	39	number 2, 4, 6, or 8, a person must be a registered voter in Real
40	40	County.
41	41	(b-4) To be eligible to be a candidate for the at-large
42	42	position, a person must be a registered voter in the District.
43	43	(c) Any vacancy occurring in the membership of the Board of
44	44	Directors shall be filled by the remaining members of the Board for
45	45	the unexpired term of such office.
46	46	(d) Before entering upon the duties of [his] office, each
47	47	member of the Board of Directors shall take the Constitutional oath
48	48	of office.
49	49	SECTION 2. (a) A member of the board of directors of the
50	50	Real-Edwards Conservation and Reclamation District serving on the
51	51	effective date of this Act shall continue in office until the
52	52	member's successor qualifies for office.
53	53	(b) At the election held November 6, 2012, four directors
54	54	shall be elected from positions 1, 2, 3, and 4.
55	55	(c) At the election held November 4, 2014, four directors
56	56	shall be elected from position numbers 5, 6, 7, and 8 and one
57	57	director elected at large.
58	58	SECTION 3. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2011.
