12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 106.14, Alcoholic Beverage Code, is |
---|
14 | 14 | | amended by adding Subsection (e) to read as follows: |
---|
15 | 15 | | (e) After notice and hearing, the commission may cancel or |
---|
16 | 16 | | suspend the commission's approval of a seller training program, the |
---|
17 | 17 | | commission's certification of a trainer to teach a seller training |
---|
18 | 18 | | program, or the commission's certification of a seller-server if |
---|
19 | 19 | | the program, trainer, or seller-server violates this code or a |
---|
20 | 20 | | commission rule. The commission may give a program, trainer, or |
---|
21 | 21 | | seller-server the opportunity to pay a civil penalty rather than be |
---|
22 | 22 | | subject to suspension under this subsection. Sections 11.62 |
---|
23 | 23 | | through 11.67 apply to the program approval or certification as if |
---|
24 | 24 | | the program approval or certification were a license or permit |
---|
25 | 25 | | under this code. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2011. |
