99 AN ACT
1010 relating to alcoholic beverage seller-servers and to seller
1111 training programs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 106.14, Alcoholic Beverage Code, is
1414 amended by adding Subsection (e) to read as follows:
1515 (e) After notice and hearing, the commission may cancel or
1616 suspend the commission's approval of a seller training program, the
1717 commission's certification of a trainer to teach a seller training
1818 program, or the commission's certification of a seller-server if
1919 the program, trainer, or seller-server violates this code or a
2020 commission rule. The commission may give a program, trainer, or
2121 seller-server the opportunity to pay a civil penalty rather than be
2222 subject to suspension under this subsection. Sections 11.62
2323 through 11.67 apply to the program approval or certification as if
2424 the program approval or certification were a license or permit
2525 under this code.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2011.
