| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 43.0751(a)(1), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (1) "District" means a conservation and reclamation |
|---|
| 13 | 13 | | [water control and improvement district or a municipal utility] |
|---|
| 14 | 14 | | district [created or] operating under Chapter 49 [51 or 54], Water |
|---|
| 15 | 15 | | Code. The term does not include a groundwater conservation district |
|---|
| 16 | 16 | | operating under Chapter 36, Water Code, or a special utility |
|---|
| 17 | 17 | | district operating under Chapter 65, Water Code. |
|---|
| 18 | 18 | | SECTION 2. Section 43.0751, Local Government Code, is |
|---|
| 19 | 19 | | amended by adding Subsection (r) to read as follows: |
|---|
| 20 | 20 | | (r) A district or the area of a district annexed for limited |
|---|
| 21 | 21 | | purposes under this section must be: |
|---|
| 22 | 22 | | (1) in the municipality's extraterritorial |
|---|
| 23 | 23 | | jurisdiction; and |
|---|
| 24 | 24 | | (2) contiguous to the corporate boundaries of the |
|---|
| 25 | 25 | | municipality or an area annexed by the municipality for limited |
|---|
| 26 | 26 | | purposes, unless the district consents to noncontiguous annexation |
|---|
| 27 | 27 | | under a strategic partnership agreement with the municipality. |

| 28 | 28 | | SECTION 3. Section 43.0751, Local Government Code, as |
|---|
| 29 | 29 | | amended by this Act, applies only to an annexation for limited |
|---|
| 30 | 30 | | purposes of an area for which a municipality institutes proceedings |
|---|
| 31 | 31 | | to annex the area on or after the effective date of this Act. The |
|---|
| 32 | 32 | | annexation of an area for limited purposes for which a municipality |
|---|
| 33 | 33 | | institutes annexation proceedings before that date is governed by |
|---|
| 34 | 34 | | the law in effect immediately before the effective date of this Act, |
|---|
| 35 | 35 | | and the former law is continued in effect for that purpose. |
|---|
| 36 | 36 | | SECTION 4. This Act takes effect September 1, 2011. |
