66 AN ACT
77 relating to strategic partnerships for the continuation of certain
88 water districts annexed by a municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.0751(a)(1), Local Government Code, is
1111 amended to read as follows:
1212 (1) "District" means a conservation and reclamation
1313 [water control and improvement district or a municipal utility]
1414 district [created or] operating under Chapter 49 [51 or 54], Water
1515 Code. The term does not include a groundwater conservation district
1616 operating under Chapter 36, Water Code, or a special utility
1717 district operating under Chapter 65, Water Code.
1818 SECTION 2. Section 43.0751, Local Government Code, is
1919 amended by adding Subsection (r) to read as follows:
2020 (r) A district or the area of a district annexed for limited
2121 purposes under this section must be:
2222 (1) in the municipality's extraterritorial
2323 jurisdiction; and
2424 (2) contiguous to the corporate boundaries of the
2525 municipality or an area annexed by the municipality for limited
2626 purposes, unless the district consents to noncontiguous annexation
2727 under a strategic partnership agreement with the municipality.
2828 SECTION 3. Section 43.0751, Local Government Code, as
2929 amended by this Act, applies only to an annexation for limited
3030 purposes of an area for which a municipality institutes proceedings
3131 to annex the area on or after the effective date of this Act. The
3232 annexation of an area for limited purposes for which a municipality
3333 institutes annexation proceedings before that date is governed by
3434 the law in effect immediately before the effective date of this Act,
3535 and the former law is continued in effect for that purpose.
3636 SECTION 4. This Act takes effect September 1, 2011.
