A BILL TO BE ENTITLED
AN ACT
relating to an insurance company's access to and removal of a motor
vehicle stored in a vehicle storage facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 2303, Occupations Code, is
amended by adding Section 2303.1601 to read as follows:
Sec. 2303.1601. ACCESS TO AND REMOVAL OF VEHICLE BY
INSURANCE COMPANY. (a) A vehicle storage facility may not refuse
to allow access to a vehicle for an inspection by, or refuse to
release a vehicle to, an insurance company that is authorized by the
owner of the vehicle to inspect or remove the vehicle under a claim
of loss on the vehicle.
(b) The commission shall adopt rules specifying the
documentation that an insurance company must present to a vehicle
storage facility when seeking access to a vehicle described by
Subsection (a) to inspect or remove the vehicle.
SECTION 2. Not later than December 1, 2011, the Texas
Commission of Licensing and Regulation shall adopt rules to
implement Section 2303.1601, Occupations Code, as added by this
Act.
SECTION 3. This Act takes effect September 1, 2011.
