99 AN ACT
1010 relating to certain prohibited dealings between a wholesaler and
1111 retailer of alcoholic beverages.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 102.32(a)(2), Alcoholic Beverage Code,
1414 is amended to read as follows:
1515 (2) "Retailer" means a package store, wine only
1616 package store, wine and beer retailers, wine and beer retailer's
1717 off-premise, or mixed beverage permittee, any other retailer, or a
1818 private club registration permittee. For purposes of this section,
1919 the holder of a winery permit issued under Chapter 16 is a retailer
2020 when the winery permit holder purchases wine from the holder of a
2121 wholesaler's permit issued under Chapter 19 for resale to ultimate
2222 consumers in unbroken packages.
2323 SECTION 2. This Act takes effect September 1, 2011.
