88 relating to the disposal of demolition waste from abandoned or
99 nuisance buildings in certain areas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 316, Health and Safety
1212 Code, is amended by adding Section 361.126 to read as follows:
1313 Sec. 361.126. DISPOSAL OF DEMOLITION WASTE FROM ABANDONED
1414 OR NUISANCE BUILDING. (a) The commission may issue a permit by
1515 rule to authorize the governing body of a county or municipality
1616 with a population of 10,000 or less to dispose of demolition waste
1717 from an abandoned building or building found to be a nuisance if the
1818 disposal occurs on land that:
1919 (1) the county or municipality owns or controls; and
2020 (2) would qualify for an arid exemption under
2121 commission rules.
2222 (b) The county or municipality must have acquired ownership
2323 or control of the building through bankruptcy, tax delinquency, or
2424 condemnation, with the previous owner of the building not being
2525 financially capable of paying the costs to transport and dispose of
2626 the demolition waste at a permitted solid waste disposal facility.
2727 (c) The commission shall adopt rules under Section 361.024
2828 to control the collection, handling, storage, processing, and
2929 disposal of demolition waste under this section to protect public
3030 and private property, rights-of-way, groundwater, and any other
3131 right that requires protection.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2011.
