99 relating to an additional fee for filing civil cases in certain
1010 Rockwall County courts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 51, Government Code, is
1313 amended by adding Section 51.709 to read as follows:
1414 Sec. 51.709. ADDITIONAL FILING FEE FOR CIVIL CASES IN
1515 ROCKWALL COUNTY. (a) This section applies only to district courts,
1616 statutory probate courts, county courts at law, and justice courts
1717 in Rockwall County.
1818 (b) Except as otherwise provided by this section and in
1919 addition to all other fees authorized or required by other law, the
2020 clerk of a court shall collect a filing fee of not more than $15 in
2121 each civil case filed in the court to be used for the construction,
2222 renovation, or improvement of the facilities that house the courts
2323 collecting the fee.
2424 (c) Court fees due under this section shall be collected in
2525 the same manner as other fees, fines, or costs are collected in the
2626 case.
2727 (d) The clerk shall send the fees collected under this
2828 section to the county treasurer at least as frequently as monthly.
2929 The treasurer shall deposit the fees in a special account in the
3030 county treasury dedicated to the construction, renovation, or
3131 improvement of the facilities that house the courts collecting the
3232 fee.
3333 (e) This section applies only to fees for a 12-month period
3434 beginning July 1, if the commissioners court:
3535 (1) adopts a resolution authorizing a fee of not more
3636 than $15; and
3737 (2) files the resolution with the county treasurer not
3838 later than June 1 immediately preceding the first 12-month period
3939 during which the fees are to be collected.
4040 (f) A resolution adopted under Subsection (e) continues
4141 from year to year until July 1, 2025, allowing the county to collect
4242 fees under the terms of this section until the resolution is
4343 rescinded.
4444 (g) The commissioners court may rescind the resolution
4545 adopted under Subsection (e) by adopting a resolution rescinding
4646 the resolution and submitting the recision resolution to the county
4747 treasurer not later than June 1 preceding the beginning of the first
4848 day of the county fiscal year. The commissioners court may adopt an
4949 additional resolution in the manner provided by Subsection (e)
5050 after rescinding a previous resolution under that subsection.
5151 (h) A fee established under a particular resolution is
5252 abolished on the earlier of:
5353 (1) the date a resolution adopted under Subsection (e)
5454 is rescinded as provided by Subsection (g); or
5555 (2) July 1, 2025.
5656 SECTION 2. Subchapter D, Chapter 101, Government Code, is
5757 amended by adding Section 101.06120 to read as follows:
5858 Sec. 101.06120. ADDITIONAL DISTRICT COURT FEES FOR COURT
5959 FACILITIES: GOVERNMENT CODE. The clerk of a district court in
6060 Rockwall County shall collect an additional filing fee of not more
6161 than $15 under Section 51.709, Government Code, in civil cases to
6262 fund the construction, renovation, or improvement of court
6363 facilities, if authorized by the county commissioners court.
6464 SECTION 3. Subchapter E, Chapter 101, Government Code, is
6565 amended by adding Section 101.08119 to read as follows:
6666 Sec. 101.08119. ADDITIONAL STATUTORY COUNTY COURT FEES FOR
6767 COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory county
6868 court in Rockwall County shall collect an additional filing fee of
6969 not more than $15 under Section 51.709, Government Code, in civil
7070 cases to fund the construction, renovation, or improvement of court
7171 facilities, if authorized by the county commissioners court.
7272 SECTION 4. Subchapter F, Chapter 101, Government Code, is
7373 amended by adding Section 101.10118 to read as follows:
7474 Sec. 101.10118. ADDITIONAL STATUTORY PROBATE COURT FEES FOR
7575 COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory
7676 probate court in Rockwall County shall collect an additional filing
7777 fee of not more than $15 under Section 51.709, Government Code, in
7878 civil cases to fund the construction, renovation, or improvement of
7979 court facilities, if authorized by the county commissioners court.
8080 SECTION 5. Subchapter H, Chapter 101, Government Code, is
8181 amended by adding Section 101.142 to read as follows:
8282 Sec. 101.142. ADDITIONAL JUSTICE COURT FEE FOR COURT
8383 FACILITIES COLLECTED BY CLERK. The clerk of a justice court in
8484 Rockwall County shall collect an additional filing fee of not more
8585 than $15 under Section 51.709, Government Code, in civil cases to
8686 fund the construction, renovation, or improvement of court
8787 facilities, if authorized by the county commissioners court.
8888 SECTION 6. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2011.
