| 7 | 7 | | relating to the authority of the State Cemetery Committee. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2165.256(a), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The State Cemetery Committee shall oversee all |
|---|
| 12 | 12 | | operations of the State Cemetery. The committee shall develop a |
|---|
| 13 | 13 | | budget for the operations of the commission relating to the State |
|---|
| 14 | 14 | | Cemetery and determine the salary of employees of the commission |
|---|
| 15 | 15 | | whose duties primarily relate to the operation of the State |
|---|
| 16 | 16 | | Cemetery. The budget and all operations and personnel of the State |
|---|
| 17 | 17 | | Cemetery are under the direct control of the committee, except that |
|---|
| 18 | 18 | | the committee may delegate this authority to the person responsible |
|---|
| 19 | 19 | | for the management of the grounds of the State Cemetery. |
|---|
| 20 | 20 | | SECTION 2. Section 2165.2561(m), Government Code, is |
|---|
| 21 | 21 | | amended to read as follows: |
|---|
| 22 | 22 | | (m) The committee may adopt rules as necessary for the |
|---|
| 23 | 23 | | administration, grounds operation, and security of the State |
|---|
| 24 | 24 | | Cemetery, including rules restricting access to all roadways and |
|---|
| 25 | 25 | | walkways within the cemetery grounds. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2011. |
