13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Chapter 614, Health and Safety Code, is amended |
---|
15 | 15 | | by adding Section 614.0205 to read as follows: |
---|
16 | 16 | | Sec. 614.0205. APPROPRIATION CONTINGENCY. The office is |
---|
17 | 17 | | required to provide a service or program under Section 614.019(a) |
---|
18 | 18 | | or 614.020 only if the legislature appropriates money specifically |
---|
19 | 19 | | for that purpose. If the legislature does not appropriate money |
---|
20 | 20 | | specifically for that purpose, the office may, but is not required |
---|
21 | 21 | | to, provide a service or program under Section 614.019(a) or |
---|
22 | 22 | | 614.020 using other appropriations available for that purpose. |

23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
---|
24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
---|
27 | 27 | | Act takes effect September 1, 2011. |
