| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 31.121, Parks and Wildlife Code, is |
|---|
| 15 | 15 | | amended by amending Subsections (a) and (e) and adding Subsection |
|---|
| 16 | 16 | | (a-1) to read as follows: |

| 17 | 17 | | (a) In this section: |
|---|
| 18 | 18 | | (1) "Game warden" means a person who is commissioned |
|---|
| 19 | 19 | | as a game warden by the commission. |
|---|
| 20 | 20 | | (2) "State military forces" has the meaning assigned |
|---|
| 21 | 21 | | by Section 431.001, Government Code. |
|---|
| 22 | 22 | | (a-1) All peace officers of this state and game wardens |
|---|
| 23 | 23 | | [commissioned by the commission] must be certified as marine safety |
|---|
| 24 | 24 | | enforcement officers by the department to enforce the provisions of |
|---|
| 25 | 25 | | this chapter by arresting and taking into custody any person who |
|---|
| 26 | 26 | | commits any act or offense prohibited by this chapter or who |
|---|
| 27 | 27 | | violates any provision of this chapter. |
|---|
| 28 | 28 | | (e) State military forces may assist game [Game] wardens |
|---|
| 29 | 29 | | [may assist] in the search for and rescue of victims of |
|---|
| 30 | 30 | | water-oriented accidents. |

| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2011. |
