99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the search for and rescue of victims of water-oriented
1212 accidents.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 31.121, Parks and Wildlife Code, is
1515 amended by amending Subsections (a) and (e) and adding Subsection
1616 (a-1) to read as follows:
1717 (a) In this section:
1818 (1) "Game warden" means a person who is commissioned
1919 as a game warden by the commission.
2020 (2) "State military forces" has the meaning assigned
2121 by Section 431.001, Government Code.
2222 (a-1) All peace officers of this state and game wardens
2323 [commissioned by the commission] must be certified as marine safety
2424 enforcement officers by the department to enforce the provisions of
2525 this chapter by arresting and taking into custody any person who
2626 commits any act or offense prohibited by this chapter or who
2727 violates any provision of this chapter.
2828 (e) State military forces may assist game [Game] wardens
2929 [may assist] in the search for and rescue of victims of
3030 water-oriented accidents.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2011.
