77 relating to contracts between rural hospitals and certain insurers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter I, Chapter 843, Insurance Code, is
1010 amended by adding Section 843.324 to read as follows:
1111 Sec. 843.324. CONTRACTS WITH RURAL HOSPITALS. (a) In this
1212 section:
1313 (1) "Ancillary services" means laboratory services,
1414 radiology services, physical therapy services, speech therapy
1515 services, or occupational therapy services.
1616 (2) "Rural hospital" means a hospital that:
1717 (A) is designated as a critical access hospital
1818 under and in compliance with 42 U.S.C. Section 1395i-4;
1919 (B) is a sole community hospital, as defined by
2020 42 U.S.C. Section 1395ww(d)(5)(D)(iii); or
2121 (C) is located in a county with a population of
2222 not more than 50,000.
2323 (b) A health maintenance organization that contracts with a
2424 rural hospital to provide services to enrollees under a health care
2525 plan may not deny the hospital the opportunity to provide ancillary
2626 services.
2727 (c) On request of a rural hospital, the commissioner shall
2828 conduct an investigation, review, hearing, or other proceeding to
2929 determine whether a health maintenance organization is in
3030 compliance with this section.
3131 (d) The commissioner shall take reasonable action to ensure
3232 compliance with this section, including issuing orders and imposing
3333 sanctions.
3434 SECTION 2. Subchapter E, Chapter 1301, Insurance Code, is
3535 amended by adding Section 1301.203 to read as follows:
3636 Sec. 1301.203. CONTRACTS WITH RURAL HOSPITALS. (a) In this
3737 section:
3838 (1) "Ancillary services" means laboratory services,
3939 radiology services, physical therapy services, speech therapy
4040 services, or occupational therapy services.
4141 (2) "Rural hospital" means a hospital that:
4242 (A) is designated as a critical access hospital
4343 under and in compliance with 42 U.S.C. Section 1395i-4;
4444 (B) is a sole community hospital, as defined by
4545 42 U.S.C. Section 1395ww(d)(5)(D)(iii); or
4646 (C) is located in a county with a population of
4747 not more than 50,000.
4848 (b) An insurer that contracts with a rural hospital to
4949 provide services to insureds under a preferred provider benefit
5050 plan may not deny the hospital the opportunity to provide ancillary
5151 services as a preferred provider.
5252 (c) On request of a rural hospital, the commissioner shall
5353 conduct an investigation, review, hearing, or other proceeding to
5454 determine whether an insurer is in compliance with this section.
5555 (d) The commissioner shall take reasonable action to ensure
5656 compliance with this section, including issuing orders and imposing
5757 sanctions.
5858 SECTION 3. This Act takes effect September 1, 2011.
