| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 1131.802, Insurance Code, is amended to |
|---|
| 16 | 16 | | read as follows: |
|---|
| 17 | 17 | | Sec. 1131.802. EXTENSION OF GROUP LIFE INSURANCE TO SPOUSES |
|---|
| 18 | 18 | | AND CHILDREN; ELIGIBLE CHILDREN. Insurance under a group life |
|---|
| 19 | 19 | | insurance policy may be extended to cover: |
|---|
| 20 | 20 | | (1) the spouse of each individual eligible to be |
|---|
| 21 | 21 | | insured under the policy; |
|---|
| 22 | 22 | | (2) a natural or adopted child of each individual |
|---|
| 23 | 23 | | eligible to be insured under the policy if the child is: |
|---|
| 24 | 24 | | (A) [unmarried and] younger than 25 years of age |
|---|
| 25 | 25 | | or an older age stated in the policy; or |
|---|
| 26 | 26 | | (B) physically or mentally disabled and under the |
|---|
| 27 | 27 | | parents' supervision; or |
|---|
| 28 | 28 | | (3) a natural or adopted grandchild of each individual |
|---|
| 29 | 29 | | eligible to be insured under the policy if the child is[: |
|---|
| 30 | 30 | | [(A) unmarried; |
|---|
| 31 | 31 | | [(B)] younger than 25 years of age or an older age |
|---|
| 32 | 32 | | stated in the policy [; and |
|---|
| 33 | 33 | | [(C) a dependent of the insured for federal |
|---|
| 34 | 34 | | income tax purposes at the time the application for coverage of the |
|---|
| 35 | 35 | | child is made]. |

| 36 | 36 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an insurance policy that is delivered, issued for delivery, |
|---|
| 38 | 38 | | renewed, or amended on or after January 1, 2012. A policy that is |
|---|
| 39 | 39 | | delivered, issued for delivery, renewed, or amended before January |
|---|
| 40 | 40 | | 1, 2012, is governed by the law as it existed immediately before the |
|---|
| 41 | 41 | | effective date of this Act, and that law is continued in effect for |
|---|
| 42 | 42 | | that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2011. |
