7	7	relating to the refusal to register motor vehicles by a county
8	8	assessor-collector or the Texas Department of Motor Vehicles.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 502.185, Transportation Code, is amended
11	11	by amending Subsections (a), (b), and (f) and adding Subsection
12	12	(f-1) to read as follows:
13	13	(a) A county assessor-collector or the department may
14	14	refuse to register a motor vehicle if the assessor-collector or the
15	15	department receives information that the owner of the vehicle:
16	16	(1) owes the county money for a fine, fee, or tax that
17	17	is past due; or
18	18	(2) failed to appear in connection with a complaint or
19	19	citation relating to a county fine, fee, or tax.
20	20	(b) A county may contract with the department or the county
21	21	assessor-collector to provide information to the department or the
22	22	assessor-collector necessary to make a determination under
23	23	Subsection (a).
24	24	(f) A county that has a contract under Subsection (b) shall
25	25	[may] impose an additional fee of $20 to:
26	26	(1) a person who fails to pay [paying] a fine, fee, or
27	27	tax to the county by the date on which the fine, fee, or tax is
28	28	[after it is past] due; or
29	29	(2) a person who fails to appear in connection with a
30	30	complaint or citation relating to a county fine, fee, or tax.
31	31	(f-1) The additional fee may be used only to reimburse the
32	32	department or the county assessor-collector for its expenses for
33	33	providing services under the contract.
34	34	SECTION 2. Section 702.003, Transportation Code, is amended
35	35	by amending Subsections (b) and (c) and adding Subsection (e-1) to
36	36	read as follows:
37	37	(b) A municipality may contract with the assessor-collector
38	38	for the [a] county in which the municipality is located or the
39	39	department to provide information to the county assessor-collector
40	40	or department necessary to make a determination under Subsection
41	41	(a).
42	42	(c) A municipality that has a contract under Subsection (b)
43	43	shall notify the county assessor-collector or the department
44	44	regarding a person for whom the county assessor-collector or the
45	45	department has refused to register a motor vehicle on:
46	46	(1) entry of a judgment against the person and the
47	47	person's payment to the court of the fine for the violation and of
48	48	all court costs;
49	49	(2) perfection of an appeal of the case for which the
50	50	arrest warrant was issued; or
51	51	(3) dismissal of the charge for which the arrest
52	52	warrant was issued.
53	53	(e-1) A municipality that has a contract under Subsection
54	54	(b) shall impose an additional $20 fee to a person who has an
55	55	outstanding warrant from the municipality for failure to appear or
56	56	failure to pay a fine on a complaint that involves the violation of
57	57	a traffic law. The additional fee may be used only to reimburse the
58	58	department or the county assessor-collector for its expenses for
59	59	providing services under the contract.
60	60	SECTION 3. The changes in law made by Sections 502.185 and
61	61	702.003, Transportation Code, as amended by this Act, apply only to
62	62	a failure to appear or a fine, fee, or tax in connection with a
63	63	complaint or citation issued on or after the effective date of this
64	64	Act. A failure to appear or a fine, fee, or tax in connection with a
65	65	complaint or citation issued before the effective date of this Act
66	66	is subject to the law in effect on that date, and that law is
67	67	continued in effect for that purpose.
68	68	SECTION 4. This Act takes effect September 1, 2011.
