| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 51, Property Code, is amended by adding |
|---|
| 13 | 13 | | Section 51.0022 to read as follows: |
|---|
| 14 | 14 | | Sec. 51.0022. FORECLOSURE DATA COLLECTION. (a) In this |
|---|
| 15 | 15 | | section, "department" means the Texas Department of Housing and |
|---|
| 16 | 16 | | Community Affairs. |
|---|
| 17 | 17 | | (b) On completion of a sale of real property, the trustee or |
|---|
| 18 | 18 | | sheriff shall submit to the county clerk a completed form that |
|---|
| 19 | 19 | | contains information on whether the property is residential and the |
|---|
| 20 | 20 | | zip code of the property or, if available, the census tract in which |
|---|
| 21 | 21 | | the property is located. |
|---|
| 22 | 22 | | (c) Not later than the 30th day after the date of receipt of |
|---|
| 23 | 23 | | a form under this section, the county clerk shall transmit the form |
|---|
| 24 | 24 | | to the department. |
|---|
| 25 | 25 | | (d) The board of the department shall prescribe the forms |
|---|
| 26 | 26 | | required under this section. The forms may only request |
|---|
| 27 | 27 | | information on whether the property is residential and the zip code |
|---|
| 28 | 28 | | or census tract of the property. |
|---|
| 29 | 29 | | (e) The department shall report the information received |
|---|
| 30 | 30 | | under this section quarterly to the legislature in a format |
|---|
| 31 | 31 | | established by the board of the department by rule. |
|---|
| 32 | 32 | | SECTION 2. (a) The board of the Texas Department of Housing |
|---|
| 33 | 33 | | and Community Affairs shall adopt the forms required by Section |
|---|
| 34 | 34 | | 51.0022, Property Code, as added by this Act, not later than January |
|---|
| 35 | 35 | | 1, 2012. |
|---|
| 36 | 36 | | (b) The change in law made by Section 51.0022, Property |
|---|
| 37 | 37 | | Code, as added by this Act, applies only to a foreclosure sale for |
|---|
| 38 | 38 | | which a notice of sale is filed on or after January 1, 2012. A |
|---|
| 39 | 39 | | foreclosure sale for which a notice of sale is filed before January |
|---|
| 40 | 40 | | 1, 2012, is governed by the law in effect on the date the notice is |
|---|
| 41 | 41 | | filed, and the former law is continued in effect for that purpose. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2011. |
