88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the eligibility of the adjutant general's department to
1111 receive Foundation School Program funding for students enrolled in
1212 the Texas ChalleNGe Academy.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 431, Government Code, is
1515 amended by adding Section 431.0401 to read as follows:
1616 Sec. 431.0401. TEXAS CHALLENGE ACADEMY. (a) For each
1717 student enrolled in the Texas ChalleNGe Academy, the department is
1818 entitled to allotments from the Foundation School Program under
1919 Chapter 42, Education Code, as if the academy were a school district
2020 without a tier one local share for purposes of Section 42.253,
2121 Education Code.
2222 (b) The department shall contract with an appropriate
2323 school district for the provision of educational services for
2424 students enrolled in the academy. The school district with which
2525 the department contracts shall be responsible for ensuring
2626 compliance with any applicable regulatory requirements imposed
2727 under the Education Code and enforced by the commissioner of
2828 education and the Texas Education Agency.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2011.
