| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter B, Chapter 431, Government Code, is |
|---|
| 15 | 15 | | amended by adding Section 431.0401 to read as follows: |
|---|
| 16 | 16 | | Sec. 431.0401. TEXAS CHALLENGE ACADEMY. (a) For each |
|---|
| 17 | 17 | | student enrolled in the Texas ChalleNGe Academy, the department is |
|---|
| 18 | 18 | | entitled to allotments from the Foundation School Program under |
|---|
| 19 | 19 | | Chapter 42, Education Code, as if the academy were a school district |
|---|
| 20 | 20 | | without a tier one local share for purposes of Section 42.253, |
|---|
| 21 | 21 | | Education Code. |
|---|
| 22 | 22 | | (b) The department shall contract with an appropriate |
|---|
| 23 | 23 | | school district for the provision of educational services for |
|---|
| 24 | 24 | | students enrolled in the academy. The school district with which |
|---|
| 25 | 25 | | the department contracts shall be responsible for ensuring |
|---|
| 26 | 26 | | compliance with any applicable regulatory requirements imposed |
|---|
| 27 | 27 | | under the Education Code and enforced by the commissioner of |
|---|
| 28 | 28 | | education and the Texas Education Agency. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2011. |
