99 AN ACT
1010 relating to the composition of the permanent advisory committee to
1111 advise the Texas Commission on Environmental Quality regarding the
1212 implementation of the ad valorem tax exemption for pollution
1313 control property.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 11.31(n), Tax Code, is amended to read as
1616 follows:
1717 (n) The Texas Commission on Environmental Quality shall
1818 establish a permanent advisory committee consisting of
1919 representatives of industry, appraisal districts, taxing units,
2020 and environmental groups, as well as members who are not
2121 representatives of any of those entities but have substantial
2222 technical expertise in pollution control technology and
2323 environmental engineering, to advise the commission regarding the
2424 implementation of this section. At least one member of the advisory
2525 committee must be a representative of a school district or junior
2626 college district in which property is located that is or previously
2727 was subject to an exemption under this section. Chapter 2110,
2828 Government Code, does not apply to the size, composition, or
2929 duration of the advisory committee.
3030 SECTION 2. As soon as practicable after the effective date
3131 of this Act, the Texas Commission on Environmental Quality shall
3232 appoint one or more representatives of school districts or junior
3333 college districts in which property is located that is or
3434 previously was subject to an exemption under Section 11.31, Tax
3535 Code, to the permanent advisory committee established under
3636 Subsection (n) of that section, as amended by this Act.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2011.
