| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter I, Chapter 651, Occupations Code, is |
|---|
| 14 | 14 | | amended by adding Section 651.4085 to read as follows: |

| 15 | 15 | | Sec. 651.4085. INTERMENT OR ENTOMBMENT. (a) A funeral |
|---|
| 16 | 16 | | director who contracts with a customer to perform funeral directing |
|---|
| 17 | 17 | | under this chapter, or an agent of the funeral establishment, shall |
|---|
| 18 | 18 | | be present when the casket containing the human body to which the |
|---|
| 19 | 19 | | contract applies is placed in a grave, crypt, or burial vault unless |
|---|
| 20 | 20 | | interment or entombment takes place at a location outside this |
|---|
| 21 | 21 | | state. |
|---|
| 22 | 22 | | (b) The funeral directing duties related to interment or |
|---|
| 23 | 23 | | entombment services are complete when the casket is placed in a |
|---|
| 24 | 24 | | grave, crypt, or burial vault. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2011. |
