99 AN ACT
1010 relating to the duties of a funeral director or an agent at the
1111 interment or entombment of a human body.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter I, Chapter 651, Occupations Code, is
1414 amended by adding Section 651.4085 to read as follows:
1515 Sec. 651.4085. INTERMENT OR ENTOMBMENT. (a) A funeral
1616 director who contracts with a customer to perform funeral directing
1717 under this chapter, or an agent of the funeral establishment, shall
1818 be present when the casket containing the human body to which the
1919 contract applies is placed in a grave, crypt, or burial vault unless
2020 interment or entombment takes place at a location outside this
2121 state.
2222 (b) The funeral directing duties related to interment or
2323 entombment services are complete when the casket is placed in a
2424 grave, crypt, or burial vault.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2011.
