9	9	relating to the regulation of distributed renewable generation of
10	10	electricity.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 39.916(a)(2), Utilities Code, is amended
13	13	to read as follows:
14	14	(2) "Distributed renewable generation owner" means:
15	15	(A) the owner of distributed renewable
16	16	generation; or
17	17	(B) a retail electric customer who contracts with
18	18	another person to finance, install, or maintain distributed
19	19	renewable generation on the customer's side of the meter,
20	20	regardless of whether the customer takes ownership of the installed
21	21	distributed renewable generation.
22	22	SECTION 2. Section 39.916, Utilities Code, is amended by
23	23	adding Subsection (d-1) to read as follows:
24	24	(d-1) If, at the time distributed renewable generation is
25	25	installed on a retail electric customer's side of the meter, the
26	26	estimated annual amount of electric energy to be produced by the
27	27	distributed renewable generation is less than or equal to the
28	28	customer's estimated annual electric energy consumption, the
29	29	commission may not:
30	30	(1) consider the distributed renewable generation
31	31	owner to be an electric utility, a power generation company, or a
32	32	retail electric provider; or
33	33	(2) require the distributed renewable generation
34	34	owner to register with or to be certified by the commission.
35	35	SECTION 3. This Act takes effect September 1, 2011.
