| 7 | 7 | | relating to notification of local groundwater conservation |

| 8 | 8 | | districts by the Texas Commission on Environmental Quality when |
|---|
| 9 | 9 | | groundwater contamination is found. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 5.236(a), Water Code, is amended to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (a) If the executive director acquires information that |
|---|
| 14 | 14 | | confirms that a potential public health hazard exists because |
|---|
| 15 | 15 | | usable groundwater has been or is being contaminated, the executive |
|---|
| 16 | 16 | | director, not later than the 30th day after the date on which the |
|---|
| 17 | 17 | | executive director acquires the information confirming |
|---|
| 18 | 18 | | contamination, shall give written notice of the contamination to |
|---|
| 19 | 19 | | the following persons: |
|---|
| 20 | 20 | | (1) the county judge and the county health officer, if |
|---|
| 21 | 21 | | any, in each county in which the contamination has occurred or is |
|---|
| 22 | 22 | | occurring; |
|---|
| 23 | 23 | | (2) each groundwater district with authority under |
|---|
| 24 | 24 | | Chapter 36 or other law to regulate water wells located in the area |
|---|
| 25 | 25 | | affected by the groundwater that has been or is being contaminated; |
|---|
| 26 | 26 | | (3) any person under the commission's jurisdiction who |
|---|
| 27 | 27 | | is suspected of contributing to the contamination; and |
|---|
| 28 | 28 | | (4) [(3)] any other state agency with jurisdiction |
|---|
| 29 | 29 | | over any person who is suspected of contributing to the |
|---|
| 30 | 30 | | contamination. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2011. |
