66 AN ACT
77 relating to notification of local groundwater conservation
88 districts by the Texas Commission on Environmental Quality when
99 groundwater contamination is found.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 5.236(a), Water Code, is amended to read
1212 as follows:
1313 (a) If the executive director acquires information that
1414 confirms that a potential public health hazard exists because
1515 usable groundwater has been or is being contaminated, the executive
1616 director, not later than the 30th day after the date on which the
1717 executive director acquires the information confirming
1818 contamination, shall give written notice of the contamination to
1919 the following persons:
2020 (1) the county judge and the county health officer, if
2121 any, in each county in which the contamination has occurred or is
2222 occurring;
2323 (2) each groundwater district with authority under
2424 Chapter 36 or other law to regulate water wells located in the area
2525 affected by the groundwater that has been or is being contaminated;
2626 (3) any person under the commission's jurisdiction who
2727 is suspected of contributing to the contamination; and
2828 (4) [(3)] any other state agency with jurisdiction
2929 over any person who is suspected of contributing to the
3030 contamination.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2011.
