99 AN ACT
1010 relating to the authority of an open-enrollment charter school
1111 operated by a municipality to give a preference in admissions to
1212 children of employees of the municipality.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 12.117, Education Code, is amended by
1515 adding Subsection (c) to read as follows:
1616 (c) An open-enrollment charter school authorized by a
1717 charter granted under this subchapter to a municipality:
1818 (1) is considered a work-site open-enrollment charter
1919 school for purposes of federal regulations regarding admissions
2020 policies that apply to open-enrollment charter schools receiving
2121 federal funding; and
2222 (2) notwithstanding Subsection (a), may admit
2323 children of employees of the municipality to the school before
2424 conducting a lottery to fill remaining available positions,
2525 provided that the number of children admitted under this
2626 subdivision constitutes only a small percentage, as may be further
2727 specified by federal regulation, of the school's total enrollment.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2011.
