| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 12.117, Education Code, is amended by |
|---|
| 15 | 15 | | adding Subsection (c) to read as follows: |
|---|
| 16 | 16 | | (c) An open-enrollment charter school authorized by a |
|---|
| 17 | 17 | | charter granted under this subchapter to a municipality: |
|---|
| 18 | 18 | | (1) is considered a work-site open-enrollment charter |
|---|
| 19 | 19 | | school for purposes of federal regulations regarding admissions |
|---|
| 20 | 20 | | policies that apply to open-enrollment charter schools receiving |
|---|
| 21 | 21 | | federal funding; and |
|---|
| 22 | 22 | | (2) notwithstanding Subsection (a), may admit |
|---|
| 23 | 23 | | children of employees of the municipality to the school before |
|---|
| 24 | 24 | | conducting a lottery to fill remaining available positions, |
|---|
| 25 | 25 | | provided that the number of children admitted under this |
|---|
| 26 | 26 | | subdivision constitutes only a small percentage, as may be further |
|---|
| 27 | 27 | | specified by federal regulation, of the school's total enrollment. |

| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2011. |
