| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 520.057, Transportation Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (a) and adding Subsections (c) and (d) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) A holder of a motor vehicle title service license shall |
|---|
| 16 | 16 | | maintain records as required by this section on a form prescribed |
|---|
| 17 | 17 | | and made available by the county tax assessor-collector for each |
|---|
| 18 | 18 | | transaction in which the license holder receives compensation. The |
|---|
| 19 | 19 | | records shall include: |
|---|
| 20 | 20 | | (1) the date of the transaction; |
|---|
| 21 | 21 | | (2) the name, age, address, sex, valid identification |
|---|
| 22 | 22 | | document [driver's license] number, and a legible photocopy of the |
|---|
| 23 | 23 | | valid identification document [driver's license] for each |
|---|
| 24 | 24 | | customer; and |
|---|
| 25 | 25 | | (3) the license plate number, vehicle identification |
|---|
| 26 | 26 | | number, and a legible photocopy of proof of financial |
|---|
| 27 | 27 | | responsibility for the motor vehicle involved. |
|---|
| 28 | 28 | | (c) A motor vehicle title service license holder must |
|---|
| 29 | 29 | | identify each customer through a valid identification document. |
|---|
| 30 | 30 | | (d) In this section, "valid identification document" means |
|---|
| 31 | 31 | | a document that contains an identifiable photograph with |
|---|
| 32 | 32 | | information concerning a particular individual that is of a type of |
|---|
| 33 | 33 | | document intended or commonly accepted for the purpose of |
|---|
| 34 | 34 | | identification of an individual and is issued by: |
|---|
| 35 | 35 | | (1) an agency or institution of the federal |
|---|
| 36 | 36 | | government; or |
|---|
| 37 | 37 | | (2) an agency, institution, or political subdivision |
|---|
| 38 | 38 | | of this state or another state. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2011. |
