66 AN ACT
77 relating to exemptions from permitting by groundwater conservation
88 districts of the drilling and operation of certain water wells.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.117(b), Water Code, is amended to
1111 read as follows:
1212 (b) A district may not require any permit issued by the
1313 district for:
1414 (1) a well used solely for domestic use or for
1515 providing water for livestock or poultry, if the well is:
1616 (A) located on a tract of land larger than 10
1717 acres; and
1818 (B) [that is either] drilled, completed, or
1919 equipped so that it is incapable of producing more than 25,000
2020 gallons of groundwater a day;
2121 (2) the drilling of a water well used solely to supply
2222 water for a rig that is actively engaged in drilling or exploration
2323 operations for an oil or gas well permitted by the Railroad
2424 Commission of Texas provided that the person holding the permit is
2525 responsible for drilling and operating the water well and the well
2626 is located on the same lease or field associated with the drilling
2727 rig; or
2828 (3) the drilling of a water well authorized under a
2929 permit issued by the Railroad Commission of Texas under Chapter
3030 134, Natural Resources Code, or for production from such a well to
3131 the extent the withdrawals are required for mining activities
3232 regardless of any subsequent use of the water.
3333 SECTION 2. This Act takes effect September 1, 2011.
