1010 administrators relating to automotive glass repair services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 2307, Occupations Code,
1313 is amended to read as follows:
1414 CHAPTER 2307. [INSURER] INTERESTS OF INSURERS AND THIRD-PARTY
1515 ADMINISTRATORS IN CERTAIN [REPAIR] FACILITIES AND SERVICES;
1616 PROHIBITED PRACTICES
1717 SECTION 2. Section 2307.001, Occupations Code, is amended
1818 by adding Subdivisions (1-a), (1-b), and (6-a) to read as follows:
1919 (1-a) "Automotive glass repair service" means a person
2020 that engages in the business of automotive glass work.
2121 (1-b) "Automotive glass work" means the installation,
2222 maintenance, or repair of fixed or moveable glass in a motor
2323 vehicle.
2424 (6-a) "Third-party administrator" means a person,
2525 other than a person licensed or otherwise authorized to engage in
2626 business under Title 13, Insurance Code, that, in connection with
2727 motor vehicle insurance coverage:
2828 (A) collects a charge or premium:
2929 (i) from a resident of this state; or
3030 (ii) paid on behalf of a resident of this
3131 state; or
3232 (B) provides administrative services to, or
3333 inspects or settles a claim by, a resident of this state.
3434 SECTION 3. Chapter 2307, Occupations Code, is amended by
3535 adding Section 2307.0025 to read as follows:
3636 Sec. 2307.0025. DECEPTIVE TRADE PRACTICE. (a) A
3737 third-party administrator that holds at least a 10 percent
3838 ownership interest in an automotive glass repair service may not:
3939 (1) refer a third-party claimant or an insured to the
4040 service;
4141 (2) coerce a third-party claimant or an insured to use
4242 the service; or
4343 (3) use consumer information obtained in the process
4444 of acting as a third-party administrator to solicit business for
4545 the automotive glass repair service.
4646 (b) A violation of this section is a false, misleading, or
4747 deceptive act or practice within the meaning of Section 17.46,
4848 Business & Commerce Code.
4949 (c) A public or private right or remedy prescribed by
5050 Chapter 17, Business & Commerce Code, may be used to enforce this
5151 section.
5252 SECTION 4. This Act takes effect September 1, 2011.
