11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter G, Chapter 104, Utilities Code, is | |
13 | 13 | amended by adding Section 104.302 to read as follows: | |
14 | 14 | Sec. 104.302. RATE ADJUSTMENTS. In establishing a gas | |
15 | 15 | utility's rates, the commission or municipal regulatory authority | |
16 | 16 | may, but is not required to, approve a tariff or rate schedule in | |
17 | 17 | which the rate for gas utility service is adjusted based on changes | |
18 | 18 | in the gas utility's revenues, expenses, or investments. Rates and | |
19 | 19 | charges resulting from tariffs or rate schedules established within | |
20 | 20 | a municipality by mutual agreement of the utility and the municipal | |
21 | 21 | regulatory authority shall be presumed reasonable by the | |
22 | 22 | commission. Nothing in this section changes the original or | |
23 | 23 | appellate jurisdiction of a municipal regulatory authority or the | |
24 | 24 | commission. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2011. |
