99 relating to health care information submitted to the Department of
1010 State Health Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 108.009, Health and Safety Code, is
1313 amended by amending Subsections (a) and (c) and adding Subsection
1414 (d-1) to read as follows:
1515 (a) The council may collect, and, except as provided by
1616 Subsections (c), [and] (d), and (d-1), providers shall submit to
1717 the council or another entity as determined by the council, all data
1818 required by this section. The data shall be collected according to
1919 uniform submission formats, coding systems, and other technical
2020 specifications necessary to make the incoming data substantially
2121 valid, consistent, compatible, and manageable using electronic
2222 data processing, if available.
2323 (c) A rural provider or a hospital may, but is not required
2424 to, provide the data required by this chapter. [A hospital may, but
2525 is not required to, provide the data required by this chapter if the
2626 hospital:
2727 [(1) is exempt from state franchise, sales, ad
2828 valorem, or other state or local taxes; and
2929 [(2) does not seek or receive reimbursement for
3030 providing health care services to patients from any source,
3131 including:
3232 [(A) the patient or any person legally obligated
3333 to support the patient;
3434 [(B) a third-party payor; or
3535 [(C) Medicaid, Medicare, or any other federal,
3636 state, or local program for indigent health care.]
3737 (d-1) A provider may elect not to participate in the data
3838 collection program under Subsection (a). The executive
3939 commissioner of the Health and Human Services Commission by rule
4040 shall establish procedures for making the election authorized by
4141 this subsection.
4242 SECTION 2. Chapter 108, Health and Safety Code, is amended
4343 by adding Section 108.0131 to read as follows:
4444 Sec. 108.0131. NOTICE REQUIRED. (a) A provider who submits
4545 data under Section 108.009 shall provide notice to the provider's
4646 patients that:
4747 (1) the provider submits data as required by this
4848 chapter; and
4949 (2) the data may be sold or distributed to third
5050 parties.
5151 (b) The department shall post on the department's Internet
5252 website a list of each entity that purchases or receives data
5353 collected under this chapter.
5454 SECTION 3. Not later than December 31, 2011, the executive
5555 commissioner of the Health and Human Services Commission shall
5656 adopt rules as required by Section 108.009(d-1), Health and Safety
5757 Code, as added by this Act, establishing procedures to allow health
5858 care providers to make the election authorized by that subsection.
5959 SECTION 4. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2011.
