99 relating to the residence address of a person for purposes of
1010 registration under the Election Code.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 1, Election Code, is amended by adding
1313 Section 1.016 to read as follows:
1414 Sec. 1.016. RESIDENCE FOR CERTAIN REGISTERED VOTERS.
1515 (a) For purposes of registration under this code, a person's
1616 residence is established at the first residence address in the
1717 following list that is applicable to the person:
1818 (1) the address the person claims as a homestead in
1919 this state;
2020 (2) the address stated on a driver's license issued to
2121 the person by the Department of Public Safety that has not expired
2222 or, if the person has notified the department of a change of address
2323 under Section 521.054, Transportation Code, the new address
2424 contained in the notification;
2525 (3) the address stated on a personal identification
2626 card issued to the person by the Department of Public Safety that
2727 has not expired or, if the person has notified the department of a
2828 change of address under Section 521.054, Transportation Code, the
2929 new address contained in the notification;
3030 (4) the address stated on a license to carry a
3131 concealed handgun issued to the person by the Department of Public
3232 Safety that has not expired or, if the person has notified the
3333 department of a change of address under Section 411.181, Government
3434 Code, the new address contained in the notification; or
3535 (5) an address corresponding to a residence at which
3636 the person receives mail.
3737 (b) The address described by Subsection (a)(5) may not be a
3838 commercial post office box or similar location that does not
3939 correspond to a residence.
4040 (c) This section does not apply to:
4141 (1) a person who is a member of the armed forces of the
4242 United States or the spouse or a dependent of a member; or
4343 (2) a person enrolled as a full-time student at an
4444 institution of higher education.
4545 (d) The secretary of state shall adopt rules as necessary to
4646 implement this section.
4747 SECTION 2. This Act takes effect September 1, 2011.
