12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 1802.051(c), Occupations Code, is | |
14 | 14 | amended to read as follows: | |
15 | 15 | (c) A person who is licensed under this chapter may not act | |
16 | 16 | as an auctioneer for an entity [an auction company] unless the | |
17 | 17 | entity: | |
18 | 18 | (1) is an auction [the] company [is] owned or operated | |
19 | 19 | by a person who is licensed under this chapter; or | |
20 | 20 | (2) holds a dealer general distinguishing number | |
21 | 21 | issued under Subchapter B, Chapter 503, Transportation Code, and | |
22 | 22 | the auction is for the purpose of auctioning vehicles as defined by | |
23 | 23 | Section 503.001, Transportation Code. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2011. | |
