99 relating to the creation of the Bell County Municipal Utility
1010 District No. 1; providing authority to impose a tax and issue bonds;
1111 granting a limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 8372 to read as follows:
1515 CHAPTER 8372. BELL COUNTY MUNICIPAL UTILITY DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 8372.001. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "Commission" means the Texas Commission on
2020 Environmental Quality.
2121 (3) "Director" means a board member.
2222 (4) "District" means the Bell County Municipal Utility
2323 District No. 1.
2424 Sec. 8372.002. NATURE OF DISTRICT. The district is a
2525 municipal utility district created under Section 59, Article XVI,
2626 Texas Constitution.
2727 Sec. 8372.003. CONFIRMATION AND DIRECTORS' ELECTION
2828 REQUIRED. The temporary directors shall hold an election to
2929 confirm the creation of the district and to elect five permanent
3030 directors as provided by Section 49.102, Water Code.
3131 Sec. 8372.004. CONSENT OF MUNICIPALITY REQUIRED. The
3232 temporary directors may not hold an election under Section 8372.003
3333 until each municipality in whose corporate limits or
3434 extraterritorial jurisdiction the district is located has
3535 consented by ordinance or resolution to the creation of the
3636 district and to the inclusion of land in the district.
3737 Sec. 8372.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3838 The district is created to serve a public purpose and benefit.
3939 (b) The district is created to accomplish the purposes of:
4040 (1) a municipal utility district as provided by
4141 general law and Section 59, Article XVI, Texas Constitution; and
4242 (2) Section 52, Article III, Texas Constitution, that
4343 relate to the construction, acquisition, or improvement of
4444 macadamized, graveled, or paved roads described by Section 54.234,
4545 Water Code, or improvements, including storm drainage, in aid of
4646 those roads.
4747 Sec. 8372.006. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act enacting this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act enacting this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.

6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8372.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8372.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8372.052. TEMPORARY DIRECTORS. (a) The temporary
6767 board consists of:
6868 (1) Roger Hunter;
6969 (2) Randy Reding;
7070 (3) David Barr;
7171 (4) Karen Walinder; and
7272 (5) David Lazar.
7373 (b) Temporary directors serve until the earlier of:
7474 (1) the date permanent directors are elected under
7575 Section 8372.003; or
7676 (2) September 1, 2015.
7777 (c) If permanent directors have not been elected under
7878 Section 8372.003 and the terms of the temporary directors have
7979 expired, successor temporary directors shall be appointed or
8080 reappointed as provided by Subsection (d) to serve terms that
8181 expire on the earlier of:
8282 (1) the date permanent directors are elected under
8383 Section 8372.003; or
8484 (2) the fourth anniversary of the date of the
8585 appointment or reappointment.
8686 (d) If Subsection (c) applies, the owner or owners of a
8787 majority of the assessed value of the real property in the district
8888 may submit a petition to the commission requesting that the
8989 commission appoint as successor temporary directors the five
9090 persons named in the petition. The commission shall appoint as
9191 successor temporary directors the five persons named in the
9292 petition.

9494 SUBCHAPTER C. POWERS AND DUTIES
9595 Sec. 8372.101. GENERAL POWERS AND DUTIES. The district has
9696 the powers and duties necessary to accomplish the purposes for
9797 which the district is created.
9898 Sec. 8372.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9999 DUTIES. The district has the powers and duties provided by the
100100 general law of this state, including Chapters 49 and 54, Water Code,
101101 applicable to municipal utility districts created under Section 59,
102102 Article XVI, Texas Constitution.
103103 Sec. 8372.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
104104 Section 52, Article III, Texas Constitution, the district may
105105 design, acquire, construct, finance, issue bonds for, improve, and
106106 convey to this state, a county, or a municipality for operation and
107107 maintenance macadamized, graveled, or paved roads described by
108108 Section 54.234, Water Code, or improvements, including storm
109109 drainage, in aid of those roads.
110110 (b) The district may exercise the powers provided by this
111111 section without submitting a petition to or obtaining approval from
112112 the commission as required by Section 54.234, Water Code.
113113 Sec. 8372.104. APPROVAL OF ROAD PROJECT. (a) The district
114114 may not undertake a road project authorized by Section 8372.103
115115 unless:
116116 (1) each municipality or county that will operate and
117117 maintain the road has approved the plans and specifications of the
118118 road project, if a municipality or county will operate and maintain
119119 the road; or
120120 (2) the Texas Transportation Commission has approved
121121 the plans and specifications of the road project, if the state will
122122 operate and maintain the road.
123123 (b) Except as provided by Subsection (a), the district is
124124 not required to obtain approval from the Texas Transportation
125125 Commission to design, acquire, construct, finance, issue bonds for,
126126 improve, or convey a road project.
127127 Sec. 8372.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
128128 OR RESOLUTION. The district shall comply with all applicable
129129 requirements of any ordinance or resolution that is adopted under
130130 Section 54.016 or 54.0165, Water Code, and that consents to the
131131 creation of the district or to the inclusion of land in the
132132 district.
133133 Sec. 8372.106. LIMITATION ON USE OF EMINENT DOMAIN. The
134134 district may not exercise the power of eminent domain outside the
135135 district to acquire a site or easement for:
136136 (1) a road project authorized by Section 8372.103; or
137137 (2) a recreational facility as defined by Section
138138 49.462, Water Code.

140140 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
141141 Sec. 8372.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
142142 district may issue, without an election, bonds and other
143143 obligations secured by:
144144 (1) revenue other than ad valorem taxes; or
145145 (2) contract payments described by Section 8372.153.
146146 (b) The district must hold an election in the manner
147147 provided by Chapters 49 and 54, Water Code, to obtain voter approval
148148 before the district may impose an ad valorem tax or issue bonds
149149 payable from ad valorem taxes.
150150 (c) The district may not issue bonds payable from ad valorem
151151 taxes to finance a road project unless the issuance is approved by a
152152 vote of a two-thirds majority of the district voters voting at an
153153 election held for that purpose.
154154 Sec. 8372.152. OPERATION AND MAINTENANCE TAX. (a) If
155155 authorized at an election held under Section 8372.151, the district
156156 may impose an operation and maintenance tax on taxable property in
157157 the district in accordance with Section 49.107, Water Code.
158158 (b) The board shall determine the tax rate. The rate may not
159159 exceed the rate approved at the election.
160160 Sec. 8372.153. CONTRACT TAXES. (a) In accordance with
161161 Section 49.108, Water Code, the district may impose a tax other than
162162 an operation and maintenance tax and use the revenue derived from
163163 the tax to make payments under a contract after the provisions of
164164 the contract have been approved by a majority of the district voters
165165 voting at an election held for that purpose.
166166 (b) A contract approved by the district voters may contain a
167167 provision stating that the contract may be modified or amended by
168168 the board without further voter approval.

170170 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
171171 Sec. 8372.201. AUTHORITY TO ISSUE BONDS AND OTHER
172172 OBLIGATIONS. The district may issue bonds or other obligations
173173 payable wholly or partly from ad valorem taxes, impact fees,
174174 revenue, contract payments, grants, or other district money, or any
175175 combination of those sources, to pay for any authorized district
176176 purpose.
177177 Sec. 8372.202. TAXES FOR BONDS. At the time the district
178178 issues bonds payable wholly or partly from ad valorem taxes, the
179179 board shall provide for the annual imposition of a continuing
180180 direct ad valorem tax, without limit as to rate or amount, while all
181181 or part of the bonds are outstanding as required and in the manner
182182 provided by Sections 54.601 and 54.602, Water Code.
183183 Sec. 8372.203. BONDS FOR ROAD PROJECTS. At the time of
184184 issuance, the total principal amount of bonds or other obligations
185185 issued or incurred to finance road projects and payable from ad
186186 valorem taxes may not exceed one-fourth of the assessed value of the
187187 real property in the district.
188188 SECTION 2. The Bell County Municipal Utility District No. 1
189189 initially includes all the territory contained in the following
190190 area:
191191 Being all that certain tract or parcel of land situated in the C. H.
192192 Fitch Survey, A-316, the John Lewis Survey, A-512, the S.C. Fitch
193193 Survey, A-371, and the Young Williams Survey, A-861, Bell County,
194194 Texas, being all of Tract One (called 442.51 acres), Tract Two
195195 (called 23.923 acres), and Tract 4 (called 8.440 acres) described
196196 in deed to Weldon Whitis and Bruce Whitis in Volume 4441, Page 575,
197197 Official Records, Bell County, Texas, and all of that certain
198198 called 64.7 acre tract described in deed to Whitis Land
199199 Investments, Ltd., in Volume 6622, Page 114, Official Records, Bell
200200 County, Texas, and being more particularly described by metes and
201201 bounds as follows:
202202 BEGINNING at an iron rod at the southeast corner of said Tract 4

378378 SECTION 3. (a) The legal notice of the intention to
379379 introduce this Act, setting forth the general substance of this
380380 Act, has been published as provided by law, and the notice and a
381381 copy of this Act have been furnished to all persons, agencies,
382382 officials, or entities to which they are required to be furnished
383383 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
384384 Government Code.
385385 (b) The governor, one of the required recipients, has
386386 submitted the notice and Act to the Texas Commission on
387387 Environmental Quality.
388388 (c) The Texas Commission on Environmental Quality has filed
389389 its recommendations relating to this Act with the governor, the
390390 lieutenant governor, and the speaker of the house of
391391 representatives within the required time.
392392 (d) All requirements of the constitution and laws of this
393393 state and the rules and procedures of the legislature with respect
394394 to the notice, introduction, and passage of this Act are fulfilled
395395 and accomplished.
396396 SECTION 4. (a) Section 8372.106, Special District Local
397397 Laws Code, as added by Section 1 of this Act, takes effect only if
398398 this Act receives a two-thirds vote of all the members elected to
399399 each house.
400400 (b) If this Act does not receive a two-thirds vote of all the
401401 members elected to each house, Subchapter C, Chapter 8372, Special
402402 District Local Laws Code, as added by Section 1 of this Act, is
403403 amended by adding Section 8372.106 to read as follows:
404404 Sec. 8372.106. NO EMINENT DOMAIN POWER. The district may
405405 not exercise the power of eminent domain.
406406 (c) This section is not intended to be an expression of a
407407 legislative interpretation of the requirements of Section 17(c),
408408 Article I, Texas Constitution.
409409 SECTION 5. Except as provided by Section 4 of this Act, this
410410 Act takes effect September 1, 2011.
