| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 53.021(d), Property Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (d) A person who provides labor, plant material, or other |
|---|
| 15 | 15 | | supplies for the installation of landscaping for a house, building, |
|---|
| 16 | 16 | | or improvement, including the construction of a retention pond, |
|---|
| 17 | 17 | | retaining wall, berm, irrigation system, fountain, or other similar |
|---|
| 18 | 18 | | installation, under or by virtue of a written contract with the |
|---|
| 19 | 19 | | owner or the owner's agent, contractor, subcontractor, trustee, or |
|---|
| 20 | 20 | | receiver has a lien on the property. |

| 21 | 21 | | SECTION 2. Section 53.021(d), Property Code, as amended by |
|---|
| 22 | 22 | | this Act, applies only to a lien claim arising under or by virtue of |
|---|
| 23 | 23 | | a contract entered into on or after the effective date of this Act. |
|---|
| 24 | 24 | | A lien claim arising under or by virtue of a contract entered into |
|---|
| 25 | 25 | | before the effective date of this Act is governed by the law |
|---|
| 26 | 26 | | applicable to the claim immediately before the effective date of |
|---|
| 27 | 27 | | this Act, and that law is continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2011. |
