99 AN ACT
1010 relating to the confidentiality of certain identifying information
1111 regarding students of career schools or colleges and other
1212 educational entities; providing a criminal penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 132, Education Code, is
1515 amended by adding Section 132.024 to read as follows:
1616 Sec. 132.024. STUDENT INFORMATION; OFFENSE; PENALTY. (a)
1717 In this section:
1818 (1) "Student" means any prospective, current, or
1919 former student of:
2020 (A) a career school or college; or
2121 (B) any other school, educational institution,
2222 or business entity from which the commission receives, or regarding
2323 which the commission reviews, information through its
2424 administration or enforcement of this chapter.
2525 (2) "Student information" means identifying
2626 information in the commission's possession regarding a student.
2727 The term includes:
2828 (A) a student's name, address, telephone number,
2929 social security number, e-mail address, or date of birth;
3030 (B) any other identifying number or other
3131 information that foreseeably could be combined with other publicly
3232 available information to reveal identifying information regarding
3333 the student; and
3434 (C) a student's education records, as defined by
3535 34 C.F.R. Section 99.3.
3636 (b) Student information is not public information for
3737 purposes of Chapter 552, Government Code.
3838 (c) Unless permitted by Subchapter F, Chapter 301, Labor
3939 Code, or commission rule, a person commits an offense if the person
4040 solicits, discloses, receives, or uses, or authorizes, permits,
4141 participates in, or acquiesces in another person's use of, student
4242 information.
4343 (d) An offense under Subsection (c) is a Class A
4444 misdemeanor.
4545 SECTION 2. This Act takes effect September 1, 2011.
