No. 2542 A BILL TO BE ENTITLED AN ACT relating to the powers and duties of the State Board of Trustees of the Texas Emergency Services Retirement System and of the fire fighters' pension commissioner. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 865.004(b), Government Code, is amended to read as follows: (b) The concurrence of a majority of the members of the state board is required for a vote regarding: (1) eligibility for service retirement described by Section 864.001; (2) the computation of a service retirement annuity described by Section 864.002; or (3) a cost-of-living increase described by Section 864.013[; or [(4) a lump-sum payment adopted under Section 864.014]. SECTION 2. Section 865.006(b), Government Code, is amended to read as follows: (b) The state board shall adopt rules the board considers necessary or desirable for the administration of the fund and the pension system. The state board shall adopt rules to provide a proration of the requirements for qualified service for a member who performs service for only a portion of a calendar year and may provide by rule for the manner in which member attendance or training hours are to be computed. SECTION 3. Section 21A(g), Texas Local Firefighters Retirement Act (Article 6243e, Vernon's Texas Civil Statutes), is amended to read as follows: (g) The fire fighters' pension commissioner shall file annually with the governor, [and] the presiding officer of each house of the legislature, and the Legislative Budget Board a complete and detailed written report accounting for all funds received and disbursed by the commissioner during the preceding fiscal year, other than funds of the Texas Emergency Services [Fire Fighters' Relief and] Retirement System [Fund] established by Subtitle H, Title 8, Government Code [under the Texas Statewide Volunteer Fire Fighters Retirement Act (Article 6243e.3, Vernon's Texas Civil Statutes)]. The annual report must be in the form and reported in the time provided by the General Appropriations Act. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2011.
