8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 361.119, Health and Safety Code, is | |
10 | 10 | amended by adding Subsection (g) to read as follows: | |
11 | 11 | (g) Land application of grit trap waste, alone or in | |
12 | 12 | combination with other waste streams, may be considered recovery, | |
13 | 13 | recycling, or reuse only if: | |
14 | 14 | (1) the grit trap waste includes no hazardous | |
15 | 15 | substance as defined by Section 361.003(11); | |
16 | 16 | (2) all of the chemical components of the grit trap | |
17 | 17 | waste solids will have a beneficial effect on the soil or crops on | |
18 | 18 | which the waste is applied; | |
19 | 19 | (3) none of the chemical components of the grit trap | |
20 | 20 | waste solids and associated liquids will have a negative effect on | |
21 | 21 | the soil or crops on which the waste is applied; and | |
22 | 22 | (4) the application volumes of the grit trap waste | |
23 | 23 | solids will not exceed the agronomic application rate for any | |
24 | 24 | chemical component of the waste. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2011. |
