99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the Texas Department of Motor Vehicles' electronic lien
1212 system.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 501.117, Transportation Code, is amended
1515 by amending Subsection (a) and adding Subsections (d), (d-1),
1616 (d-2), (e), and (f) to read as follows:
1717 (a) The department by rule shall develop a system under
1818 which a security interest in a motor vehicle may be perfected,
1919 assigned, discharged, and canceled electronically instead of by
2020 record maintained on a certificate of title. The department may
2121 establish categories of lienholders that may participate in the
2222 system and, except as provided by this section, may require a
2323 lienholder to participate in the system [Participation by a
2424 lienholder in the system is voluntary].
2525 (d) The department may not require a depository
2626 institution, as defined by Section 180.002, Finance Code, to
2727 participate in the system if the department has issued fewer than
2828 100 notifications of security interests in motor vehicles to the
2929 depository institution during a calendar year.
3030 (d-1) The department may not require a depository
3131 institution, as defined by Section 180.002, Finance Code, to
3232 participate in the system:
3333 (1) during 2011, if the department issues fewer than
3434 200 notifications of security interests in motor vehicles to the
3535 depository institution between September 1, 2011, and December 31,
3636 2011; and
3737 (2) during 2012, if the depository institution was
3838 exempt under Subdivision (1) and the department issues fewer than
3939 200 notifications of security interests in motor vehicles to the
4040 depository institution in 2012.
4141 (d-2) This subsection and Subsection (d-1) expire January
4242 1, 2013.
4343 (e) The department by rule shall establish a reasonable
4444 schedule for compliance with the requirements of Subsection (a) for
4545 each category of lienholder that the department requires to
4646 participate in the system.
4747 (f) The department may not:
4848 (1) prohibit a lienholder from using an intermediary
4949 to access the system; or
5050 (2) require a lienholder to use an intermediary to
5151 access the system.
5252 SECTION 2. This Act takes effect September 1, 2011.
