| 9 | 9 | | relating to the preparation of economic impact statements for |
|---|
| 10 | 10 | | legislative measures. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Sections 315.004(a) and (b), Government Code, |
|---|
| 13 | 13 | | are amended to read as follows: |
|---|
| 14 | 14 | | (a) At the request of the lieutenant governor, the [or] |
|---|
| 15 | 15 | | speaker of the house of representatives, or a committee of a house |
|---|
| 16 | 16 | | of the legislature, a state agency shall prepare an economic impact |
|---|
| 17 | 17 | | statement for any pending bill or joint resolution that directly |
|---|
| 18 | 18 | | affects that agency. Preparation of the statement shall be |
|---|
| 19 | 19 | | coordinated through the Legislative Budget Board director. |
|---|
| 20 | 20 | | (b) The economic impact statement must include: |
|---|
| 21 | 21 | | (1) a brief description of the nature and effect of the |
|---|
| 22 | 22 | | proposal; [and] |
|---|
| 23 | 23 | | (2) a statement of the manner and extent to which the |
|---|
| 24 | 24 | | proposal, if implemented, will directly or indirectly during each |
|---|
| 25 | 25 | | of the five [two] years following its effective date: |
|---|
| 26 | 26 | | (A) affect employment in the state, including the |
|---|
| 27 | 27 | | number of people affected, the geographic area or areas affected, |
|---|
| 28 | 28 | | and the existing level of employment and unemployment in those |
|---|
| 29 | 29 | | areas; |
|---|
| 30 | 30 | | (B) affect the construction, modification, |
|---|
| 31 | 31 | | alteration, or utilization of any structure, equipment, facility, |
|---|
| 32 | 32 | | process, or other asset in the state, including the estimated |
|---|
| 33 | 33 | | dollar measure of the action and the geographic area or areas |
|---|
| 34 | 34 | | affected; |
|---|
| 35 | 35 | | (C) result in changes in costs of goods and |
|---|
| 36 | 36 | | services in the state; |
|---|
| 37 | 37 | | (D) result in changes in revenue and expenditures |
|---|
| 38 | 38 | | of state and local governments; and |
|---|
| 39 | 39 | | (E) have economic impacts within the state other |
|---|
| 40 | 40 | | than those specifically described by this subsection; and |
|---|
| 41 | 41 | | (3) a general statement of the analysis described by |
|---|
| 42 | 42 | | Subdivision (2) for the remainder of the 20-year period following |
|---|
| 43 | 43 | | the proposal's effective date. |

| 44 | 44 | | SECTION 2. This Act takes effect September 1, 2011. |
