12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Sections 13.1396(b), (c), (d), (e), and (g), |
---|
14 | 14 | | Water Code, are amended to read as follows: |
---|
15 | 15 | | (b) An affected utility shall submit to [the county judge,] |
---|
16 | 16 | | the office of emergency management of each county in which the |
---|
17 | 17 | | utility has more than one customer, the Public Utility Commission |
---|
18 | 18 | | of Texas, and the office of emergency management of the governor[,] |
---|
19 | 19 | | a copy of: |
---|
20 | 20 | | (1) the affected utility's emergency preparedness plan |
---|
21 | 21 | | approved under Section 13.1395; and |
---|
22 | 22 | | (2) the commission's notification to the affected |
---|
23 | 23 | | utility that the plan is accepted. |
---|
24 | 24 | | (c) Each affected utility shall submit to each electric |
---|
25 | 25 | | utility that provides transmission and distribution service to the |
---|
26 | 26 | | affected utility, each retail electric provider that sells electric |
---|
27 | 27 | | power to the affected utility, [the county judge and] the office of |
---|
28 | 28 | | emergency management of each county in which the utility has water |
---|
29 | 29 | | and wastewater facilities that qualify for critical load status |
---|
30 | 30 | | under rules adopted by the Public Utility Commission of Texas, [and |
---|
31 | 31 | | to] the Public Utility Commission of Texas, and the division of |
---|
32 | 32 | | emergency management of the governor: |
---|
33 | 33 | | (1) information identifying the location and |
---|
34 | 34 | | providing a general description of all water and wastewater |
---|
35 | 35 | | facilities that qualify for critical load status; and |
---|
36 | 36 | | (2) emergency contact information for the affected |
---|
37 | 37 | | utility, including: |
---|
38 | 38 | | (A) the person who will serve as a point of |
---|
39 | 39 | | contact and the person's telephone number; |
---|
40 | 40 | | (B) the person who will serve as an alternative |
---|
41 | 41 | | point of contact and the person's telephone number; and |
---|
42 | 42 | | (C) the affected utility's mailing address. |
---|
43 | 43 | | (d) An affected utility shall: |
---|
44 | 44 | | (1) annually submit the information required by |
---|
45 | 45 | | Subsection (c) to each electric utility that provides transmission |
---|
46 | 46 | | and distribution service to the affected utility and to each retail |
---|
47 | 47 | | electric provider that sells electric power to the affected |
---|
48 | 48 | | utility; and |
---|
49 | 49 | | (2) immediately update the information provided under |
---|
50 | 50 | | Subsection (c) as changes to the information occur. |
---|
51 | 51 | | (e) Each [Not later than February 1 of each year, the county |
---|
52 | 52 | | judge of each county that receives the information required by |
---|
53 | 53 | | Subsections (c) and (d) shall: |
---|
54 | 54 | | [(1) submit the information for each affected utility |
---|
55 | 55 | | to each retail electric provider that sells electric power to an |
---|
56 | 56 | | affected utility and each electric utility that provides |
---|
57 | 57 | | transmission and distribution service to an affected utility; and |
---|
58 | 58 | | [(2) in cooperation with the] affected utility shall |
---|
59 | 59 | | [,] submit annually to each electric utility that provides |
---|
60 | 60 | | transmission and distribution service to the affected utility and |
---|
61 | 61 | | to each retail electric provider that sells electric power to the |
---|
62 | 62 | | affected utility [for each affected utility] any forms reasonably |
---|
63 | 63 | | required by an electric utility or retail electric provider for |
---|
64 | 64 | | determining critical load status, including a critical care |
---|
65 | 65 | | eligibility determination form or similar form. |
---|
66 | 66 | | (g) If an electric utility determines that an affected |
---|
67 | 67 | | utility's facilities do not qualify for critical load status, the |
---|
68 | 68 | | electric utility and the retail electric provider, not later than |
---|
69 | 69 | | the 30th day after the date the electric utility or retail electric |
---|
70 | 70 | | provider receives the information required by Subsections (c) and |
---|
71 | 71 | | (d), shall provide a detailed explanation of the electric utility's |
---|
72 | 72 | | determination to the affected utility and the office of emergency |
---|
73 | 73 | | management of each county in which the affected utility's |
---|
74 | 74 | | facilities are located [each county judge that submitted the |
---|
75 | 75 | | information]. |
---|
76 | 76 | | SECTION 2. Section 13.1396(a)(2), Water Code, is repealed. |
---|
77 | 77 | | SECTION 3. This Act takes effect immediately if it receives |
---|
78 | 78 | | a vote of two-thirds of all the members elected to each house, as |
---|
79 | 79 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
80 | 80 | | Act does not receive the vote necessary for immediate effect, this |
---|
81 | 81 | | Act takes effect September 1, 2011. |
